1949537 2011-02-02 Violation(s) Noted Inspection was conducted during routine site visit.

Well pad had no erosion issues. Site was very wet and icy due to inclement weather conditions. Water storage impoundment appeared adequate. Drum containing lubricating fluid was found on its side. No leaks were visible.

Inspection revealed the following deficiencies: 1. On the south corner of site (outside of the well pad) there was an active excavation project being conducted. There were no E&S controls around this area. Sediment was freely leaving the site, down the access road and flowing onto Uschak Road T924. 2. Possible permit amendments may be needed for the above mentioned earth disturbance.

1953041 2011-02-08 Outstanding Violations - No Viols Req'd : Inspection was follow-up to 2-2-2011 inspection. Excavation outside of drill pad is on going. Stone and sand removal from this site is being used in construction of the Marco 1H (42-129-28441) well pad. According to David Freudenrich (Williams) there was an excess of 66,000 cu yds of stone after blasting for the creation of the Uschak well pad. This excess material is now being reused to construct the new pad. HRI is doing the excavation of the excess material from the Uschak site. Tom McCombie (HRI) was contacted concerning the E&S issues at this site. Extra compost sock was added to the site. Mr. McCombie stated that he will be on site tomorrow (2-9-2011) to make improvements to the controls. At the time of the inspection no erosion issues were noted. Site was frozen.
1953061 2011-02-09 Outstanding Violations - No Viols Req'd Met Tom McCombie (HRI) and Randy Reimold (Williams) to discuss E&S controls. HRI plans to add comnpst socks where needed as well as a rock lined ditch to collect any further runoff from site. Temperatures were in the teens and ground was frozen, therefore no erosion was taking place during site visit.
1953085 2011-02-15 Outstanding Violations - No Viols Req'd Follow up inspection concerning previous violation (Inspection #1949537) of E&S controls on excavation area.

A rock line ditch was installed along south side of entrance. Called Randy Reimold (Williams) and Tom McCombie (HRI) to discuss inadequacies of the upgrades. Met Dennis Graham (ARM) and Jack Brandt (HRI) to discuss further upgrades. They agreed to make the following changes:

1. Install filter sock along exposed to of newly excavated slope.
2.  Scrape accumulated mud from entrance way and add fresh stone.

Mr. McCombie planned to be on sight on 2-16-11.

1953094 2011-02-16 Outstanding Violations - No Viols Req'd Follow up inspection concerning previous violation (Inspection #1949537) of E&S controls on excavation area.

Access road had been scraped of mud. Still adding to E&S controls project. Spoke to Jack Brandt (HRI) on site. They will be adding to the rock line ditch along township road. Also, they will be adding sock and vegetative matting in exposed slope areas. No new violations noted.

Upgrades to project have been completed. Updates to area have held after heavy rains and snow melt. No new erosion from this area evident. Rig and equipment have been removed from pad. Pit contained cuttings and fluid. Cuttings were mounded above 2¿ freeboard line (liquid was below freeboard). Suggest remove cuttings to avoid possible violation. No violations noted at this time.

Site had a great deal of water. Pit fluid level was above top of pit, i.e. no free board. Fluid had flowed over liner and onto pad. Immediately told company man Tom Bell at Marco well about situation. Spoke to Randy Reimold around 16:30. He stated he checked levels last week and they were ok. He would send tankers to remove fluid. Sample 0629711 was taken of the pit fluids at 16:50. Results pending.
