| At the time of inspection the Operator was in the process of cutting and removing trees and underbrush.  The inspection at the request of the Operator to inspect perimeter BMP controls prior earth disturbance. At the time of inspection the Erosion and Sedimentation plan was on site and implemented as designed.  No observation of accelerated E&S issue in relation to proposed well pad area or the access road.  The Department suggests that the Operator continue to monitor the site weekly and after significant precipitation events to ensure the stability of the site in maintained.

| In Compliance with Policy

| Inspection the result of the Operator reporting a breached BMP during a precipitation event.  The Operator is in compliance with the Departments notification policy for a BMP breach.  During the inspection the Department notes that an infiltration ditch located closest to the access road failed during a heavy precipitation event in the early morning hours on 6/13/2013.  The failure resulted in material from the infiltration ditch being washed into a 32" silt sox, which did not contain the material and also failed.  The two failures resulted is accelerated erosion of the access road and scouring of a hillside below the excavated pad area.  The precipitation event appears to exceed the Departments criteria for construction standards.  The Operators response was to rebuild the failed portion of the infiltration ditch, add an additional rock outlet and repair the silt sox.  The Department suggests the Operator continue to monitor the site weekly and after significant precipitation events to ensure the stability of the site is maintained.

| Inspection the result of a spill reported to the Department on 8/6/2013 at 11:50am.  The Department recognizes that the Operator in in compliance with the Departments spill policy.  At the time of inspection the Operator indicated that approximately 1.5 barrels of drilling water spilled off of containment. The Operator indicated the drilling water contained liquid aluminum, defoamer, flocculants and surfactants.  The MSDS sheets for these substances were on site and supplied to the Department upon request.  During the inspection the Operator vacuumed the affected area and excavated the affected media for disposal.  The affected area was approximately 20'x25'x8".  The Department suggests the Operator submit confirmatory sample results of the drilling water, affected media and background to verify clean up.
