PIT LOOKS GOOD, ECA WAS SHUT DOWN FOR A FEW DAYS FIXING A PARTED SEAM IN THE PIT LINER WHICH MAY HAVE BEEN CAUSED BY BUILDING PITS ON THE FILL SIDE OF LOCATION. PREVIOUS WET WEATHER MADE DETECTING THE LEAK DIFFICULT, BUT HILLSIDE IS DRY NOW AND NO LEAKS ARE VISIBLE. RIG IS CLEAN AND SITE LOOKS GOOD. |

The Department discovered the leaking pit. The Operator failed to properly notify the Department. The Department has not received the waiver for the blue-line tributary to Muddy Creek. The Operator has disturbed soil and encroached on a stream without a permit (Less than 10 feet from stream) as mentioned in the 3/5/10 NOV.
