Inspection revealed the following deficiencies:

 1)  Discharge of pollutional materials in the form of sediment to waters of the commonwealth. -  Due to the slope/layout of the site and 
      access road a large volume of water and sediment ran off the site and down a portion of the access road to a low lying area.  From this 
      point the sediment was carried along the low lying area and into an adjacent pond approximately 200 feet from the access road and well 
      site.  Sediment laden run off was observed flowing from the site/access road and directly into the pond which was completely brown from sediment.  This flow was approximately 3 to 4 feet wide and had overwhelmed the BMP's that were installed.  2)  Failure to minimize accelerated erosion, implement E&S plan, maintain E&S controls, and to stabilize site.  Access road was not stable at time of inspecti

Follow up revealed drill pit and site backfilled and regraded to redirect runoff away from access road and discharge point. Silt fence trenched in. Additional rock installed on access road. Site and disturbed areas along access road have been seeded/mulched. No additional sediment observed flowing into the pond, but pond is still extremely dirty and sediment could be seen in the pond. Operator should contact owner to discuss this. Compliance inspection to be done after suitable veg begins to ensure that final stabilzation is adequate to prevent further pollution of sediment. Temp controls in place. Operator should closely monitor site to ensure temp controls and restoration is ok.

NOV issued on 7/26/10 for: 1) Discharge of pollutional materials in the form of sediment to waters of the commonwealth, 2) Failure to minimize accelerated erosion, implement E&S plan, maintain E&S controls, and stabilize site. Compliance Evaluation inspection revealed the following: Drill pit and site has been backfilled and regraded to avoid the runoff from the site being directed toward the access road and the discharge point. Silt fence has been trenched in. Additional rock has been applied to the access road for further stabilization. Site and disturbed areas along the access road have been seeded/mulched. Site is stabilized with vegetation. Site and access road are stable, with no signs of accelerated erosion. No signs of additional sediment discharge to adjacent pond. Temporary E&S controls in place and maintained. No additional violations found. Site is in compliance.
