Spill was reported to B.Shank by Operator representative Rusty Kraft.At 0807 on 4/30, Department contacted Mr. Kraft via phone. Per Mr. Kraft, a disconnected brine tank was on the well site waiting to be hauled away for proper disposal. At 2030 on 4/28, a resident notified Mr. Kraft of crude oil spilling out from the top of the tank. Mr. Kraft estimates of release of ¼ bbl crude oil and stated that he immediately attempted to contact Mr. Shank via phone and text message to notify him of the release.Upon notification of the release, Mr. Kraft stated that he immediately placed barriers around the release to contain the fluids and placed absorbent pads on the impacted materials. 2368837 Primary Facility 05/01/2015 Incident- Response to Accident or Event Violation(s) Noted On-site inspt conducted in response to inspection record 2368760 for the release of ¼ bbl crude oil.At time of inspt, all visibly impacted materials appear removed.Area of excavation approx 25’x40’ in size and backfilled, seeded, mulched.No roll-off box on-site.BT remains on-site adjacent to AR.WT present, legible. Well head and associated equipment appears rusty.Drilling occurred 3/8/1985-3/13/1985.Faint gas odor noted.AR vegetated.Environ'l Trainee Cindy Witham present during inspt.A FUI will be conducted to ensure site is properly remediated and restored.Viols are being issued under 78.54 & 78.57(a) for this reportable release of residual fluids.Following this inspt, Dept contacted Opr rep R.Kraft via phone.Dept recommended Opr re-install E&S BMPs down-gradient of excavation and ensure any contaminants that remain on brine tank are prevented from reaching the ground in order to prevent any additional pollution events from occurring.Mr. Kraft agreed to immediately implement the Dept’s recommendations.

2392401 Primary Facility 07/16/2015 Administrative/File Review In Compliance with Policy Admin insp conducted in response to viols issued under record 2368837 (enf ID 323093) for the 4/28 reported release of ¼ bbl crude oil.At 1414, Dept spoke to Opr rep J.Haskins via phone in response to the submittal of the disposal manifest for the fluids removed from the BT.Per the initial reporting of the incident, no brine was reported to have been in the brine tank; however, the invoice lists the fluids as “brine water” while the manifest reports “0% salt” in the fluids.Mr. Haskins infers that the use of “brine water” is standard on the invoices and that only freshwater was hauled.Mr. Haskins believes that someone put freshwater and/or freshwater with oil in their empty BT which resulted in the overflow. Mr. Haskins believes that the fluids emptied from the BT were “not produced fluids from their well”.The Dept inquired about status of disposal manifests for materials excavated from site during spill remediation efforts.Mr. Haskins believes records have just been received and will submit them to the Dept.
