Request for waiver of distance requirements from Laural Branch Run. The following revisions were received for this waiver request:

 1)  E&S plan revised to include additional BMP's to minimize the potential for E&S issues at the site.  Filter fence backed by hay bales to 
      be installed along entire down-slope portion of site and access road.
 2)  Tophole water is to be taken to an approved treatment facility.  Tophole water can not be discharged on site due to site conditions.
 3)  Additional soil information submitted which indicated a need to change the method used for disposing of drill cuttings.  Disposal 
     method changed to land application.  Operator referred to 78.63 for guidance on this.  The above concerns were discussed on site with operator representative Kris Suhadolnik.  Also addressed some possible wetland areas on site that must not be disturbed, and was assured that they would not be by Mr. Suholdonik.  With the above revisions, the proposed plan should protect the stream.
