| On 10/14 at 11:05, MRM received a call from Bath Township Fire Dispatch reporting an oil spill at the Bath Nature Preserve in the 4200 block of Ira Road. OEPA had been notified and Kurt Kollar with DERR was on site. I contacted Steve Swain with Oil & Gas Solutions (OGS), the operator on the property. OGS mobilized company equipment and personnel and contracted Moore Well Services to assist in the clean-up. OEPA directed the placement of booms and siphon dams along Ira Road and in North Fork Creek. On site equipment included two vac-trucks, two minihoes, one trackhoe, one dozer, and pickup trucks.

OGS operates 14 wells on this property, 7 of which share this tank battery. The tank battery includes three 200 barrel stock tanks. There are two load lines associated with this tank battery. The primary line is located at the tank battery. A second buried 3 load line (which is no longer used but is still connected) extends from the tank battery to the Nature Preserve entrance, approximately 300' northeast. According to OGS, Ergon was onsite for an oil pickup on 10/13. After starting to load his truck at the tank battery, the Ergon driver noted a high brine content, red carded the tank and returned what was on his truck to the stock tank. The tank battery load line valve was closed and plugged. However, the valve at the bottom of the tank was left open, which allowed the stock tank to drain into the buried load line. The release occurred about midway along the line. After surfacing near the load line, the spill continued north following natural drainage to Ira Road; entered a culvert and crossed under Ira; turned east along the north side of Ira; entered another culvert and crossed back under Ira; and continued east along the south side of Ira before discharging into North Fork Creek. In all, the spill traveled approximately 1100 feet before entering North Fork Creek. The release is estimated at 80 barrels. The initial response has been directed to containing the spill before it enters North Fork Creek and recovering product already in the creek. Recovery operations will continue until dark and resume in the morning.

| The impacted soil and vegetation, both north and south of Ira Road, has been removed and disposed. The main siphon dam on the north side of Ira will be replaced and re-enforced for winter. The dam will then remain in place until spring. All other siphon dams have been removed. The spill is nearly remediated and the NOV should be corrected with new growth in the spring.

| On site with Supr. Simmers. Spill remediation is ongoing. Activity today shifted from recovery in North Fork Creek to recovery along Ira Road. The grass wetland across from Bath Nature Preserve has been channeled which has permitted oil to flow freely toward the siphon dams. All three siphon dams are operational. The dam placed in North Fork Creek was washed out during heavy rains last night. The dam was being replaced today. Oil recovery has totaled 40 barrels. Kurt Kollar with OEPA is still supervising and directing remediation.

1066306092 2003-10-14 Production Wells Violations Noted On 10/14 at 11:05, MRM received a call from Bath Township Fire Dispatch reporting an oil spill at the Bath Nature Preserve in the 4200 block of Ira Road.

A second buried 3 load line (which is no longer used but is still connected) extends from the tank battery to the Nature Preserve entrance, approximately 300 northeast. The initial response has been directed to containing the spill b

1067869125 2003-10-22 Production Wells Violations Noted Status check inspection of spill remediation. Sorbent pads and booms are being replaced as needed. Impacted soil and vegetation on south side of Ira Road west of the Nature Preserve entrance have been removed and stockpiled on plastic. The impacted soil and vegetation on the north side of Ira Road still needs to be removed and disposed.
1068690978 2003-10-24 Production Wells Violations Noted Sorbent pads and booms are being replaced as needed.
1070283995 2003-11-24 Production Wells Violations Noted The impacted soil and vegetation, both north and south of Ira Road, has been removed and disposed. The main siphon dam on the north side of Ira will be replaced and re-enforced for winter. The dam will then remain in place until spring. All other siphon dams have been removed. The spill is nearly remediated and the NOV should be corrected with new growth in the spring.
1265812091 2003-04-30 Production Wells No Violations The violation has been corrected.
1575331432 2003-10-15 Production Wells Violations Noted On site with Supr.
1896927462 2003-11-03 Production Wells Violations Noted Impacted soil and vegetation on the north side of Ira Road has been removed and stockpiled on plastic. According to Steve Swain, this material will be disposed at the Petrocell facility.
1971247109 2003-08-27 Production Wells No Violations CASE 03-033 The gas leak in the gathering line was repaired and the location remediated. Violation corrected.
2000784065 2003-11-05 Production Wells Violations Noted Sorbent pads and booms are being replaced as needed. The stockpiled soil and vegetation still needs to be disposed.
