| I responded to a request from the property owner's brother, Mr. Ronald Thomas, for an inspection of the well.  My inspection found the well not in production.  A ball valve on the main flow line was closed indication the well was shut-in.  There was a 2" existing domestic gas line.  The domestic meter was covered by a wooden box.  The tank battery contained two, 100 barrel production tanks, two, brine tanks, and two separators.  An identification sign was posted on a production tank with the previous owner's name and emergency contact.  The entire tank battery was overgrown with weeds and grass.  There were plugs on the load lines.  The lease road was being maintained by the landowner.  I researched our database and found zero annual production reported from 2004 through 2012.  When, I informed Mr. Thomas that I would need to issue a compliance notice to plug the well for non-production to Enervest.  Mr. Thomas stated he did not want the well plugged because he would lose domestic gas.  Also, when I told Mr. Thomas that Enervest would need to clean up the tank battery; Mr. Thomas stated he did not want Enervest on his property.  Mr. Thomas claimed to have a royalty check sent to him and his brother, Mr. Ronald Thomas, from Enervest in 2011.  Mr. Thomas refused to cash the check; stating that no one from Enervest had been to the well.  Next, Mr. Thomas claimed to have court documentation stating the lease holding the property to the well had been cancelled for non-production.  I called Larry Lower, field supervisor with Enervest, at 216-570-8708.  Larry stated he would talk to his supervisors concerning the royalty check.  I told Larry a compliance notice would be issued for non-production.  I took photos of the well site and tank battery.  The tank battery was shared with permit number 2-1296.
