Previously, a T&F rep stated to his knowledge that the fluids were pumped out of the pit prior to encapsulation/backfilling, but based on current information it appears that operator was not present during the encapsulation process and (based on ¿contractor¿s best recollection¿) that just prior to backfilling, the drill pit did contain fluids, about half full and contractor (Hillsdale) removed water ¿by puncturing liner at base with hoe.¿ Violations being issued for failure to comply with 78.60 abd 78.62. |

On June 14, 2011, the department collaboratively reviewed the final soil boring investigation results, submitted by Chambers Environmental on behalf of T &F Exploration, and concluded that based on the evidence provided from the soil analysis it does not appear (based on these findings) that former pit contents (cuttings, frac, or flowback) were released into the ground, although operator is still being held responsible for improper encapsulation techniques of pits. |
