On 10/7/10, Ken stated that to his observation all liquid fraction had been removed from drill pit, pit in question. Dept is currently awaiting response from operator with pit use and disposal methods, as well as manifests. During, this site inspection, no violations were noted at this time BUT final results pending on pit disposal methods recieved from operator. |

Bill confirmed Ken¿s recollection of events, that pit was pumped out by Dively trucking and that prior to back filling (to their knowledge) all liquid fraction had been removed from drill pit, pit in question by complainant. Ken noted that overnight on Thurs Oct 7, 2010, heavy rains occurred in the area and pit was backfilled on Friday Oct 7, 2010, which may have been what was seen in the pit (if indeed liquid was noted) earlier in the day prior to backfilling., but last observation no know liquid was in drill pit. The drill pit was lasted used for the plugging operation for in/out flow. Impoundment pit is empty of all contents and scheduled to be backfilled/restored either tomorrow or Monday (10/17/10) weather pending. Operator agreed to provide dept with written correspondence on pit contents/disposal methods and manifests/narratives from hauler. Based on current findings it does not appear that liquid flowback was backfilled, BUT FINAL RESULTS ARE P E N D I N G |

Based on the response received by Department from T&F exploration dated 11/24/10, the dept concludes that the operator improperly encapsulated the drill pit on site by ¿puncturing liner¿ to disperse what operator estimates as 2,000bls of rainwater. Previously, a T&F rep stated to his knowledge that the fluids were pumped out of the pit prior to encapsulation/backfilling, but based on current information it appears that operator was not present during the encapsulation process and (based on ¿contractor¿s best recollection¿) that just prior to backfilling, the drill pit did contain fluids, about half full and contractor (Hillsdale) removed water ¿by puncturing liner at base with hoe.¿ Violations being issued for failure to comply with 78.60 abd 78.62. |

Well plugged. Erected monument with permit Id attached. Operator has plans to remove access road from well site (per agreement with landowner). Currently awaiting receipt of pit soil sampling findings which will be reviewed by department and a final determination made. No accelerated ES issues note, bmp's in place until final restoration. Today, no violations observed. Follow up inspection will be conducted to ensure permanent restoration achieved. Accompanied by Ed Mokos during inspection. |

Upon the department¿s request on12/09/10, T&F Exploration agreed to conduct a soil boring investigation to determine IF their improper encapsulation techniques may have adversely impacted (leached into) the ground beneath the former pit location. On June 14, 2011, the department collaboratively reviewed the final soil boring investigation results, submitted by Chambers Environmental on behalf of T &F Exploration, and concluded that based on the evidence provided from the soil analysis it does not appear (based on these findings) that former pit contents (cuttings, frac, or flowback) were released into the ground, although operator is still being held responsible for improper encapsulation techniques of pits. |
