 Onsite meeting with Jason Wells Wilmoth, Parker Surveying Reps, WQSS Ed Ritzer, Environmental Trainee Samantha Foulk and myself. meeting was devised by operator upon departments request (10/10/12 INSPT) to determine minimum depth of seasonal high ground water table. After digging a test pit adjacent to drill pit, Parker Surveying determined seasonal high ground water table was at approximately 2.35ft from ground surface.  While onsite operator agreed to dispose of all pit contents at  approved facilities according to regulations and provide the department with manifests of final disposition. 

Based on today's findings and documentation provided to the department from Parker Surveying--previously pending inspection is now violatoins. As operator failed to construct onsite drill pit at a minimum of 20in above SHGWT.

Well drilled and fraced.ite has not yet been temporarily stabilized as a result violations will be issued for operators failure to properly temporarily stabilize well site after 4 days of cessation activity. Hence well site was not properly stabilized with an acceptable bmp and/or seed/mulch accelerated erosion occurred along access road and entrance to well site observed. Department noted that rock outlet has been washed out by recent heavy rains. It appears operator installed several sections of filter fence down gradient from well pad in order to help minimize the potential for accelerated sedimentation. In addition to filter fence, operator installed a drainage dike from the left side of the site thru the access road and down to the lower right side of access road, which appears to have increased the accelerated erosion concerns To date, operator has not yet provided evidence on depth of SHGWT.

Violations issued on 11/08/12 regarding temporary stabilization were addressed. Site temporarily stabilized with seed, mulch. No vegetative growth noted. Access road adequately rocked and unlined ditch removed. Operator installed culvert at pad entrance. One lined, below-grade pit containing frac sand, drill cuttings, and water, with over two feet freeboard. Department awaiting SHGWT depth results as requested on 10/10/12 inspection, still "pending". Meeting scheduled with Parker Surveying and Operator on 11/29/12. Department recommends Operator does not encapsulate pit until SHGWT is determined. No E&S issues observed in relation to well pad or access road at the time of this inspection. Department recommends Operator continues to monitor and maintain site and access road as necessary until final permanent restoration is achieved.

2128907 2013-01-08 Outstanding Violations - No Viols Req'd Well site ID sign, Es plan, and permit onsite. Well is drilled, equipped and in production (Rig Skid to 1A, previous well 1 plugged, with errected monument.) Brine tank appears sound.Access road and site snow covered; therefore, unable to determine stabilization condition and/or if any accelerated erosion or sedimentation concerns existed. It appears that operator has several bmp's installed, again due to snow coverage department is unable to adequately asses their condition and functioning ability. epartment is strongly recommending that operator continue to closely monitor and maintain site until final permanent restoration is achieved. One below grade, lined pit remains on site with contents

( frozen liquid fraction and cuttings). As previously noted, department is requesting that upon final disposition that the operator submit disposal records for pit and contents, i.e. manifests. Outstanding violations exist, but no new violations noted

2131598 2013-01-08 In Compliance with Policy *RIG SKID* BOND RELEASE NOt APPLICABLE AT THIS TIME. CERTIFICATE OF PLUGGING RECEIVED 10/24/12.

Well plugged 10/23/12 and rid was skid approximately 15ft to Henry 1A location. A 1.5" pipe has been erected above ground to indicate location of plugged well. Hence rig was skid and "Henry 1A" subsequently drilled department is not recommending bond release. Department acknowledges that well plugged and monument erected in located of plugged well. Site not yet restored and Henry 1A drilled and in production at the time of this inspection. Operator is in compliance with current policy in relation to well plugging.
