| FOLLOW UP TO NOV #  -588817506 An inspection conducted with Mr. Robert Stonerock, Oil & Gas South Region Supervisor, revealed that the final restoration does not meet ORC 1509.072.  Black plastic line was observed below the well site location and routed to location continuing for a substantial distance off property.  All line and related equipment will need to be removed.  The well site did not contain vegetative growth.  Gravel placed around the well location and oil stained ground shall be removed in order to vegetation.  Lime, seed and mulch will need to be applied.  An earthen dike remains and will need to be graded.  Currently, the lease road is acceptable.  Background: Prior to inspection, courtesy verbal notifications have been provided to Chieftain Energy to serve as a reminder to complete final restoration.  The inspection was also delayed in order to provide more time for company to achieve compliance.  The well was plugged and abandoned on 8/10/2009.  On 6/14/2010, Chieftain Energy Contractor, Mr. Ron McBride was reminded, in the field at non-related well location, final restoration was due.  Mr. McBride stated that black plastic line routed in length of 1 mile would need removed.  On 7/12/2010, Mr. Doug Kitchen was notified of failure to restore by telephone at 10:16 a.m.  Please note that failure to comply with this notice may result in a enforcement action referral.  Bond Forfeiture: Per SB 165 (effective 6/30/2010), ORC 1509.071 now states that forfeiture of surety bond for three or more wells, the owner, operator, producer or other person shall repost a surety bond in the amount of fifty thousand dollars.
