1405866557 2014-07-10 I received a call From Denny Dugan (owner of Valley Petroleum) on 7/9/2014 that the EPA had been out to the rig for a follow up complaint call about stream pollution. During his visit to the rig Kenny Rich of (Kenny Rich Drilling) admitted to the EPA inspector (Mike Dalton ) that he had indeed pumped down his cutting pit into a small stream that flowed into Wakatomika Creek turning the water to gray in color and visibility of 1 inch into the water, approximately 1 mile of waters were affected. Kenny Rich was sited and given a Notice of violation from the EPA inspector. This is in violation of the oil and gas laws and needs to stop. The remedy for this compliance notice is to stop pumping out pits into unauthorized areas and be pumped out and disposed of according to the law. Failure to comply with this order could result in further actions being taken for violation of the law. Wildlife officers investigated and did down stream inspections for fish kill and found no fish kill associated with this violation. The streams cleared in approximately 48 hours of the time of the incident. Water samples were taken from the drill cutting containment pit. The ph. was 7 and the chloride strip gave a reading of 124 which is below the 154 drinking water standard. Inspector Thomas Benko was on site to assist with the water sampling. 9-1-07
