-1246335529 2008-06-03 Inspection this day to re-examine frac water dumping down the hill, with Supervisor Joe Hoerst. Incident happened last July, 07 and soil samples were taken and analyzed. Ground still is not growing grass and several big trees have been killed. Met with landowners and Kristy and Brian Chavez, new owners/operators of company to discuss how to reclaim. Will write NOV to confirm what we talked about - Chavez's refused to put in culvert that landowner requested - told them it may be required later. If they do not comply with the plans we discussed, will issue fine and turn over to At. Gen. NONE(A)
-367249373 2007-06-13 Inspection this day found location has been reclaimed, well is producing thru casing. Current chart in meter, good ID's, good dike around tanks, location has been seeded and mulched. Nothing growing yet but has been no rain - told them I would pass but may have to go back in the fall and re-seed.
-896041460 2008-04-23 Re-inspect this day hoping to find kill area has grown back and everything green. No luck - still is strip of ground 10' wide, 150+' long downhill from tanks where they emptied frac tanks last Fall. Took soil samples at the time and showed contamination. Today found still nothing growing in the area, 5 medium sized trees killed and all the little scrub trees and berry bushes, briars and rose bushes are dead. Area is badly eroded due to stream running down thru the area, trees on either side of it are leafed out - many dead trees laying on the ground (due to dozer work). After they dumped water, came in with dozer and tried to cover the damage up, knocking down many trees that are still laying there. Will take supervisor out to view, took pictures this day and will discuss what next step for punishment will be. Location still has trash, porta-john on it and not much vegetation. Good ID's, believe they are now hauling water from the tanks, well producing.
1190133919 2007-09-17 Re-inspect this day to get some better pictures. Talked to landowner who was out pumping his wells and told me when charts usually changed, that water tank almost full. Will monitor to see if has it hauled away or if going to dump it down the hill. He said old wells are not being pumped, suggested he document this and document tank gauging to verify - Heinrich says he is faithfully pumping old wells. Hasn't turned any production in. Pictures of kill area taken, another soil sample taken.
1191334107 2007-10-02 Re-inspect this day. Found tank still full of water - has not dumped, chart changed yesterday but making very little, vegetation still showing signs of saltwater kill but leaves turning and falling off so won't be long until evidence not as noticible. Real test will be in Spring to see if trees have leaves.
1219068310 2008-08-15 Inspection this day found brine kill area has been reclaimed satisfactorily. Hay bales have been place across ravine and seem to have slowed erosion, grass is growing nicely over most of the area, big trees that were dead and were cut down have had branches taken off them so are laying flat and helping to stop erosion. Water still washing down this slope but believe we have done about all we can do - will continue to monitor and operator has been told that if erosion becomes a problem, he will be required to come back in and fix again.
1618084063 2007-09-14 Inspection this day due to complaint from landowner that he was not getting paid - Carl had told him well not making anything. Told him we could not help with legal matters - chart shows well is not now making much. When looked behind tanks, found large kill area where they had emptied frac water before removing the tanks. Area about 10' x 550', beginning in edge of woods beside tanks and traveling downhill, crossing road on next flat down and even further downhill before stopping above next flat down, almost to bottom of hollow. Large trees in center of the kill area are starting to die - leaves falling off when other trees on either side of kill's path are still green and keeping their leaves. A dozer has been used to smooth out the dirt and cover/destroy the killed brambles and brush beginning at the top of the slope and downward about 100-150' where they stopped dozing. Soil samples were taken at 3 locations - top, middle and bottom of kill area and pictures taken. Samples sent off to Kemron. Crew had specifically said they were hauling all their water but suspect this was done while I was on vacation at end of June. Quite a steep slope so water ran downhill far. Also can see deep ditch cutting across the lease road where tanks on high side of the road were emptied and ran across the road. Area inside dike was damp but believe that is from holding rain, not saltwater. Don't believe they are draining tanks, but one tank almost full so time will soon tell.
1877103312 2010-05-06 Inspection this day with Supervisor Stonerock found well producing, tank has good ID's, valves open and current chart in meter. Good dike, full of fresh water, no grass growing on location and erosion becoming a problem. Supervisor concerned over brine kill area, examination shows still some dead trees standing and erosion downhill becoming a problem from small drainage running thru kill area.
560971450 2008-07-18 Inspection this day for clean-up. Said they wanted to start early - at 6 AM, but I am the only one here. Finally arrived at 6:30 AM - scattered a pick-up bed load of mushroomcompost/dirt over bad spots where grass still not growing, placed a few more bales of straw to stop erosion and reseeded/limed bare spots still needing some grass. Should take care of the problem and grass going good by 8/15/08, which was the deadline agreed upon. Will continue to monitor.
