4279182 2002-02-22 Inspection requested by Jay Cheslock for Tim Augastine (Bowser-Morner) 937-236-8805, ext. 273; fax 937-233-2016 for a well located at Summit Disposal, a C & D landfill. I met Dawn Schade, Site Manager and was shown the well and tank battery by a worker named Neil. The landfill wants to expand and would like to get the well plugged. The landfill owns the surface rights and the adjacent landowner, Mr. Burkhart, owns the mineral rights. Atlas America produces the well and Mr Burkhart receives house gas from the well. Atlas wanted to plug the well in 1990, but Mr. Burkhart created such a huge objection that Atlas did not plug the well. I talked with Terry Whitehair (Atlas) and discussed the situation with him. He said that Atlas is willing to work with all the parties involved. There are NO VIOLATIONS at the wellhead or tank battery and the State cannot issue a produce or plug order. I called Tim Augastine (Bowser-Morner) and informed him of my inspection and findings. I also faxed him information (permit, completion record, map, and production record) on the well.
