1269i1278 2002-08-12 Follow-up on verbal Notice of Violation, Non-Compliance. Company has removed leaking brine tank from site. Company has covered brine soils in dike with dirt and lime, covered kill area around dike with dirt and lime, did not go over hill into run and clean up area. After covering these areas company then seeded and mulched. Contaminated soils are still on site, all contaminated soils need to be removed and disposed of properly. Called Mr. Tucker at approx. 7:50 am and notified him that the clean up did not correct the violations, told him there would be a court case and fine for the violations. Explained to him again what needed to be done to correct the violations.

ER# has been corrected on tank battery. Called Mr. Tucker and told him to call Dave Clark or Joe Hoerst, to set up a meeting with them next Friday.

127772629 2002-08-09 An inspection of the tank battery revealed dike standing full of brine, brine has ran from production tank. There are holes in the tank which company has placed screws, and a wooden plug from a stick. Brine has flowed out and killed areas beside and below the dike, ran down a small creek approx. 100'ft, done a Quantab testing of the brine, field reading is over 6600 ppm of Chloride. Brine crystals line the top of the dike. Took water and soil samples of contamination for legal actions. Notified Mike Tucker(owner) of violations and told him to get started cleaning up and correcting violations. E.R. number is not correct. See drawing for kill areas. ALL BRINE CONTAMINATED SOILS NEED REMOVED FROM SITE, HAUL TO EPA APPROVED LANDFILL, REMOVE LEAKING TANK OR REPAIR TANK. HAUL IN FRESH TOP SOIL, FOR EVERY LOAD HAULED OUT, HAUL FRESH LOAD IN. GRADE, SEED, LIME AND MULCH ALL AREAS THAT WERE CONTAMINATED. NEED CORRECT PHONE NUMBER ON ID. REQUEST A COPY OF S.P.C.C. PLANS FOR THIS FACILITY.
