Company rep Steve Smith reported to Department a 7.5 bbl brine release discovered at 1:00pm on 5/6/13. At this time, exact cause of release unknown, believed to be hole in production tank. Tank no longer leaking. No waterways reported to be affected. A follow-up inspection will be conducted in future to assess any environmental impacts of release and to ensure site is properly cleaned up and restored. Violations are being issued for this reportable release of production fluids under 25 PA CODE 78.54 in addition to 78.57, 91.34 and SWMA 301.

2169966 2013-05-22 Outstanding Violations - No Viols Req'd Response to spill incdt as follow-up to admin inspt record 2166547. Reported release of 7.5 bbl brine from fiberglass tank reported on 5/6/13.

Well-tender who discovered release on-site. WT suspects crack in tank as source of release largely due to groundhog burrowing under tank; believes burrow caused uneven support/pressure on bottom of tank, resulting in split. BT removed off-site. Impacted materials previously excavated, high composition of subsurface appears to be shale rock. Orange security fence surrounding area of excavation. Five roll-off boxes full of contaminated materials on-site. As per e-mail from XTO rep S. Smith, Opr is planning on following Act 2 and will submit a final report within 90 days. Dept recommends Opr installs new BT in secondary containment unit and/or utilize steel tank and continue to monitor and maintain well site throughout clean-up efforts as necessary. A follow-up inspection will be conducted to ensure that site is properly cleaned-up and restored. Outst viols exist, no new viols issued.

2217299 2013-10-29 Outstanding Violations - No Viols Req'd Follow-up in response to violations issued under inspection record 2166547 for the reportable release of production fluids on 5/6/13.

At time of inspection, well equipped for production. New brine tank installed, on gravel pad, appears sound. Well tag present, legible. Access road stable. Previously excavated area backfilled. Areas of disturbance seeded/mulched with no vegetative growth observed. Site temporarily stabilized. Department recommends Operator continue to monitor and maintain well site to ensure adequate vegetative growth is properly restored and temporary stabilization is maintained.

Outstanding violations exist, no new violations noted at this time.

2235903 2014-01-13 Outstanding Violations - No Viols Req'd Follow-up in response to violations issued under inspection record 2166547 for the reportable release of production fluids on 5/6/13.

At time of inspection, well equipped for production. Well tag present, legible. Brine tank sound. Access road in good condition. Site temporarily stabilized with mulch, minimal vegetative growth observed. No accelerated erosion or sedimentation issues observed in relation to access road or well site at this time. Department recommends Operator continue to monitor and maintain well site to ensure adequate vegetative growth is properly restored and temporary stabilization is maintained.

Outstanding violations exist, no new violations noted at this time.
