1855991198 2010-11-23 A landowner complaint was received by the Division alleging non-production for several years. An inspection revealed that this well does not meet commercial production and is idle, as defined under Ohio Revised Code 1509.062 (A)2. Records further indicate violations of Ohio Revised Code 1509.062 (A)1, (B) and 1509.11, due to no reported production since 2006 and compliance history with subject well. The valves were observed closed on the pumping tee and casing side of well. The well was equipped with a pumping unit with engine, belts and attached 1.25 black plastic routed above ground along woodline to common (shared) tank battery consisting of two (2) 100 bbl tanks. The polish rod showed signs of non-production. Production records show only years 2002 to 2006 under this well. 9 bbl of oil was reported for 2005. Due to shared tank battery, Permit No. 868 contains statements which show 1996, as last year for production. Division Records do not indicate frac, and show only open hole. Well Compliance History: The Oil and Gas Commission affirmed Chiefs Order 2004-37 and referenced that the 2005 reported value of 9 bbl does not meet commercial production. Courtesy notices to plug or produce James and Orlan Perry wells have been provided to the well owner, Chieftain Energy, and Paul Grim employees since 2008. The last two notifications were provided to Chieftain Energy, in the field, on 9/14/2010, 10/8/2010 and 11/16/2010. The production status of this well has not changed since 2008. Pollution and contamination now observed at well location. Approximately 250 bbl horizontal frac tank contained a 2' x 1' rectangle shaped opening in bottom. Old oil (weathered/broke down) measured approx 40' x 1' from location over hillside. A second 100 bbl tank exists on its side, and contained 5' diameter hole and wet at top. Met with the landowner following the inspection to discuss results. This case will be handed over to Mr. Robert Stonerock, Oil and Gas South Region Supervisor.

826460237 2010-11-24 A voicemail message was left for Mr. Doug Kitchen, President of Chieftain Energy, on his cell phone at 2:29 pm. No answer therefore, a voicemail message was left stating idle wells and housekeeping required for James Perry #2 because of old oil release from frac tank over hillside. Requested a return call first of next week to talk about his plan for wells.
