1235054933 2009-02-17 This is a follow up inspection after the oil spill on 1-10-09. I informed Herald Oil that the tank dike had oil in it and it needed to be cleaned up during the spill cleanup efforts. No effort has been made to clean up inside the dike. The company phone number does not have a voice mail I have tried to call on 2-17,18,19-09. I am sending this NOV by mail.
1236690275 2009-01-11 Clean up oil spill. Dug out 2' by 2' by 1' deep pits and used squeegee to move oil to pit then removed oil with water truck. Spread peat sorb out on some of the location. They ran out of peat sorb and had to order more. They also used up all of their absorbing pads. To compensate for running out of absorbing products they spread out hay bales in the ditch and on the entire location. 3 vac trucks were filled with oil and water from the site today.

1248357004 2009-04-28 Received a call from Clyde Fitch (Landowner) 740-367-0009. Mr. Fitch was not satisfied with the clean up and restoration efforts of Herald Oil. Mr. Fitch wanted the site re-graded to allow easier mowing. Mr. Fitch said that there was oil still in the field. The oil was a residue that was breaking down. I instructed Travis Pierce (Herald Oil) To scrape up the residue and apply lime and fertilizer to site along with seed and mulch. Mr. Fitch wants the ruts from the tank to the road fixed. The ruts are slight 3 deep with good vegetative growth on the access road. Herald Oil has provided proof of a right of way for the access road. The access road is not causing erosion at this time. Oil boom still in place at stream intersection with Kyger Creek. No oil observed at boom. I told Mr. Fitch that I will have my supervisor look at the site to make a determination, either the site should be re-graded or not.
-1327185548 2009-02-26 New section of flow line was tested with air to 40 psi. Air test leaked down to 30 psi with in 15 minutes. Leaking fittings at the 2 inch valve were observed. Leaking tank has been removed from dike and taken off location. Peatsorb has been applied to oil inside the dike. No absorb pads were being used at the time of inspection. Took pictures.
-1358008518 2009-05-13 I called Clyde Fitch (Landowner) on 5-13-2009 at 3:00pm To discuss his complaint about the ruts in his field and the overall cleanup efforts of Herald Oil. I explained to Clyde that Herald Oil has achieved vegetative cover and is not causing erosion. Herald Oil has a right of way to drive through the field. The bare areas are to be treated with lime and fertilizer to achieve vegetative growth. I told Clyde that I had the South Region Supervisor Robert Stonerock on the site and Robert said that we cannot require Herald Oil to re grade the field. I told Clyde that the contamination within the dike has been absorbed and will be removed.
-166720424 2009-01-10 I received a call from Dennis Deavers OEPA on Saturday the 10th of January at 6 pm. Dennis told me that an oil spill was reported on Rt 554 out side of Cheshire. I met Dennis on site along with Herald Oil men. It was determined that a flow line had leaked out underground. The tank valve was not locked and someone either left the valve open or the valve was opened by someone. The contamination was located at GPS N38.96809 / W 082.12445. Estimated spill volume is oil 5 barrels, and brine at 5 barrels. The estimates were based on OEPA estimates of oil on surface, and the brine estimate is based on Herald Oil estimates. The rain and saturated ground made it impossible to distinguish brine from fresh water. The entire field had standing water in it. The oil spread out over the affected area making a perimeter of 379 feet. The total affected area is 7,699 square feet. During the clean up, numerous oil booms were placed along the ditch line and across the road to prevent oil from entering Kyger Creek. Kyger Creek was near flood stage and touching the edge of Rt 554. Three water truck loads of oil and water were hauled away. Approximately 150 barrels of water and oil total. Due to the rain event and the ground being saturated it was not possible to determine how much of the water extracted from the site was brine or fresh water. Hay bales were used to contain oil and also to line the ditch to absorb the oil.

-307599425 2009-01-13 Oil spill clean up. I inspected the site at 3:15 pm on 1-13-09. No one was working during the inspection. Oil was present in the small pits and absorbing pads needed to be changed. Pictures of the site were taken.
437497783 2009-03-05 Oil spill follow up. New soil has been graded. Grass seed and mulch have been applied to location. Still have oil residue on leaves and grass in the ditch. Used absorb pads are strewn between the edge of Kyger Creek and ST Rt 554. I called Frank Herald and told him I want this site cleaned up today. Frank came to location with two men and the oil residue was removed from the ditch line and placed in trash bags. The used absorb pads were picked up and disposed of in trash bags. All but one oil boom was removed. I told them to leave it in place until Dennis Deavers OEPA signs off on the clean up. The leaking tank has been removed from the dike and hauled off. Dike still has contamination in it. peatsorb has been applied no absorbent pads were in use with in the dike at the time of inspection. I asked Frank when the clean up in the dike will be done. His answer was that they are working on it.
-640576494 2009-05-06 Oil spill follow up. Water has pooled in all low areas on site. Oil sheen has been marked with spray paint on ground. Ditch line has a slight sheen in it. Boom located across road has been removed by flood waters of Kyger Creek. Tank Dike has not been cleaned out.

665056426 2009-02-17 Herald Oil has excavated some of the ditch line. Pockets of oil are still seeping out of the ground. It appears that a new section of flow line has been installed it has a new valve near St Rt 554. Pictures were taken. They still have oil in the dike. Some brush has been removed around the dike. I called Dennis Deavers and asked him to call me in regards to the clean up status. I called Herald Oil and did not get a answer or a voice mail.
-991711227 2009-01-14 Oil spill site. During the inspection I could not determine if any work had been done to the location since my last inspection on 1-13-09. I called Heralds office and told them that they need to continue to be diligent in their efforts to clean up the oil spill. I requested that they apply additional peat sorb to contaminated areas per OEPA recommendations. I requested to be informed of their schedule to excavate the flow line and that I want to witness the excavation.
