0161856838 2018-04-11 Production Wells No Violations I was notified that the compliance notice was returned as unclaimed, so I hand delivered a copy to Clayton King on 4/10/18. Clayton claimed that he was working on the dike and he wanted to put more saw dust down. When I visited the site today I found that the soil and gravel in the dike was still saturated with oil and there were numerous oily pads strewn throughout the area. The pads and soil in the area below the dike were showing more oil saturation than on my previous visit. I did not find that any of the oil from Clayton King draining rain water out of the dike had got past the boom that I requested he install. I also did not find any signs of oil in any of the vernal pools in the immediate area. I took more photographs to document Claytons progress.
0188765687 2018-03-20 Production Wells No Violations On the day of my inspection I found that the two 55 gallon drums were empty and on their sides. There was very little progress with removing the oil saturated material from the dike. There has been intermittent rain throughout the day and there was some oil staring to pool in the dike. Clayton King was not working at the location. I called him and he said that he would try to get back out today to dig more out. He asked if he could put more sawdust down to try to absorb more of the oil. I told him that he could. I took more photos to show the progress.
0336889256 2018-04-27 Production Wells No Violations On the day of my inspection I found that nothing had been done since my last inspection. Nothing more had been done to the lower area and none of the oily sawdust had been removed from inside of the dike. The dike was still holding rainwater, which had an oily scum floating on top. There were several oily pads floating on the water. I called Clayton to ask what he was going to do and he gave me a list of more excuses as to why he hasnt got anything done since our last conversation. I am referring this issue to the Southeast Regional Supervisor Brent Bear and Enforcement Coordinator Richard Anderson.

I called Clayton King and he claimed that he would be at the site within a half an hour. I told him that I would meet him here so we could go over the site and what remains to be done to bring the site into compliance. He showed up and started digging the old sawdust out of the dike. I left to inspect another well and then I returned to follow up on his progress. Clayton had most of the sawdust oil stained gravel shoveled into a pile and into a 55 gallon drum. He claimed that he would have it ready for a final inspection by Thursday.

0682765660 2018-03-05 Production Wells No Violations On the day of my inspection I found that most of the oily gravel and soil had been removed from the dike. They had scraped down to bare, oil-free soil. There was still oil soaked gravel around the edges of the tanks and in the grassy edge of the inside dike wall. I waked up to the area where Clayton was taking the material to be land-farmed. There were several small piles of oily soil and gravel spread out across the top of Claytons hay field. The oil was suspended in the material and I did not find anything running away from the piles. The pads and boom were still in place in the area below the dike and none of the soil had been disturbed. I called Clayton and instructed him to finish removing all of the oily material from inside of the dike, and to clean the oil off of the side of the tank. I also requested that he treat and mix the oily soil piles right away. He said that he would treat them with lime and manure and then churn then with his chisel plow. He wanted to leave the lower area alone until all the work is completed in the dike.
0726870781 2018-02-26 Production Wells No Violations On the day of my inspection I found that nothing more had been done at the site since my last inspection on Friday. The oily sawdust was still in the dike and the absorbent pads were still in the area below the dike. None of the soil had been removed. The front dike wall had not been built up and there was not any more booms around the dike. The inside of the dike was relatively dry considering the amount of rainfall over the weekend. I did not find any signs that any oily water had drained over the front of the dike and there were no signs of additional oil in the area where the pads were down. I called Clayton King to ask get a verbal plan of action, but he didnt answer and I could not leave a voice message.

0974457611 2018-01-22 Production Wells No Violations On the day of my inspection I found that most of the snow had melted in the dike, revealing the remnants of the spill. There was still quite a bit of oil in the dike. The oil was in a fluid state due to the recent rise in air temperature. There was granulated lime spread over the top of the affected area, but there was still at least two barrels of free oil floating on the snow melt water. I called Clayton King to ask if he can come out to the site today to get more of the oil pumped back into the tank, and spread some saw dust or peat on the area to at least suspend the remaining oil until he can get it shoveled up. Clayton said that he would be out this afternoon to work on it.
1005506825 2018-08-20 Production Wells No Violations On the day of my inspection I found that nothing more had been done since my last visit to the site. No more of the oily saw dust, soil or gravel had been removed since the last time I spoke with Clayton King. The skid-loader was still parked in the dike and the 55 gallon drum was still sitting in front of the tank. I referred this non-compliance issue to the Southeast District Supervisor Mike Moreland. I took photos of the current state of the clean-up and sent them to Mike.
1080265638 2018-09-07 Production Wells No Violations Clayton King called again to ask if I could inspect the site to resolve the compliance notice. On the day of my inspection I found that he had the inside of the dike clear of oily soil, gravel and saw dust. The oil was also cleaned off of the front of the tank. Clayton had built up the front of the dike with clean soil. The clean-up is satisfactory. I notified Clayton that I was closing the compliance notice, and he was clear to put new gravel back in the dike.

1252946147 2018-03-12 Production Wells No Violations On the day of my inspection I found that nothing more had been done to remove any of the oil saturated gravel and soil from the containment dike. Clayton King showed up at the site while I was there. He started digging around in the dike and laying out his plan to let the material set in the dike until it rains more and floats more of the oil up to the surface, where he can absorb it with pads. I did not agree to his proposed plan of action. I told Mr. King that he must remove all of the soil and gravel that is saturated with oil from the dike. I told him that it needs to be done right away. I reminded him that I discovered the oil in the dike on 1/5/18 and he has done very little to this point. Clayton became combative and started digging deep into the dike questioning me when he had dug deep enough. The hole started to fill with water and oil seeping out of the surrounding gravel. I then conveyed a clear plan to Clayton and made sure he understood my instructions. Clayton King, owner of Royalty Enterprises, is to physically remove all of the oil saturated soil and gravel from inside of the dike. He has been granted permission to bio-remediate the material on his property. He has been instructed to treat the soil and gravel with granulated lime and fertilizer or manure. Once the soil has been treated he has been instructed to churn the soil to allow for even air and sun exposure. When I inspect the dike and determine that enough of the saturated material has been removed Clayton is allowed to spread sawdust on the area and to use his absorbent pads to pick up any residual oil left in the dike that was not removed with the soil. He is then to treat the inside of the dike with lime and fertilizer to neutralize any remaining hydrocarbons before adding new gravel.

Royalty Enterprises filed production reports for 20 barrels of oil in 2012 and 10 barrels of oil for 2013. I met with Clayton King in regards to the well. He claimed that the well was also making house gas for the landowner. There were no leaks or spills around the wellhead. The well was not identified. This well is in compliance for production. Mr. King claimed that he would get the identification posted.

1515183204 2018-01-05 Production Wells No Violations On the day of my inspection I was driving past the production equipment and I noticed that one of the 100 barrel tanks looked like it had been run over. I found that there was approximately 3 to 4 barrels of crude oil in the dike around the front of the tank. The temperatures have been in the single digits for the past few days and the oil was very thick. None of the oil had migrated out of the shallow dike. I called Clayton King to ask what he was doing about it. He said that the incident occurred four days ago, and he was going to pump the oil back into the tank and treat the area with peat. The ground is frozen and the oil is so thick that it is staying contained and on the surface. I will check back early next week to follow up on the progress of the clean-up.
1515509763 2018-01-09 Production Wells Violations Noted On Friday, January 5th I discovered that one of the 100 barrel tanks had been run over, resulting in approximately 3 to 4 barrels of crude oil on the ground in the dike. I called Clayton King on that day and he claimed that he would get it cleaned up over the weekend. On the day of my inspection I found that nothing had been done to remove any of the crude oil from the ground inside of the shallow dike. The temperatures have risen to slightly above freezing and the oil is starting to spread out as it liquifies. The oil has not migrated out of the dike at this point. There were fresh tire tracks back to the tanks and foot tracks in the dike around the tanks. There was one small area that had been shoveled into a pile of oily sludge and gravel. The soil underneath was saturated with oil. The front of the tank, tank valve and load line were also covered with oil. The crude oil must be removed from the ground and the production equipment. The oil saturated soil and gravel must be removed from the dike and disposed of at an EPA approved landfill, or the soil can be bio-remediated with a mixture of granulated lime and fertilizer, or another approved hydrocarbon neutralizing agent. The required actions must be completed within two weeks of the date of the issuance of this compliance notice.
1516215575 2018-01-17 Production Wells No Violations On the day of my inspection I found that Clayton King was at the production equipment site checking on his tank valves to ensure they werent frozen. I stopped and spoke with Clayton about the progress of his clean-up. There was at least 6 inches of snow on the ground and I could not see the area that was affected by the oil. Clayton claimed that he has got as much of the free oil sucked out of the dike as he could get with his pump and he put back in the tanks. He said that he also had the fluid hauled from the tanks. Clayton claimed that he spread 500 pounds of granulated lime on the affected area before the most recent snow. He said that he was still going to treat the area with manure and Bio-sorb once the snow melts off.
1516818284 2018-01-24 Production Wells No Violations On the day of my inspection I found that Clayton King had dumped saw dust on the remaining crude oil that he could not pump out of the dike. Most of the oil was suspended in the sawdust, with some small saturated areas where free oil was sitting on top. I called Clayton to ask what his plan was now. He said that he was bringing more sawdust out today to cover the rest of the area. He asked what my recommendation was and I told him that he will need to remove the oil soaked saw dust before treating the area with lime, fertilizer or Bio-Sorb. I suggested that he contact a landfill to dispose of the material. Clayton said he would call around today and get back with me. All of the crude oil was still within the earthen containment dike.
1517407404 2018-01-31 Production Wells No Violations On the day of my inspection I found that Clayton King had spread more saw dust over the oil in the dike. There was no free oil, it was all soaked up into the saw dust. Clayton still needs to remove the oil soaked saw dust and treat the area to neutralize any residual contamination of the soil in the dike. There were no signs that any oil had gotten outside of the containment area.
1519226904 2018-02-21 Production Wells No Violations On the day of my inspection I found that Clayton King was not at the site. The oil soaked absorbent pads were still in place and no new ones had been put down. None of the oily sawdust in the dike had been removed. I walked through the cattails below the open area and I did not find any signs of crude oil. I also did not find any signs of oil in the intermittent stream. I found another pool closer to the road that was cloudy and generally suspicious in appearance. I collected a water sample to test for chlorides. I did observe a frog in the pool while collecting the sample. I tested the water with a low range Quantab and it showed no chlorides. I called Clayton King to ask why he was not out here. I told him to meet me at the site with a shovel, plastic bags, clean absorbent pads and a couple booms. He said he would be here within an hour. Clayton picked up the old pads and put them in a plastic trash bag. He then put down new pads over the oil. He agreed to get a boom and he dug a shallow improvised containment ditch where I wanted him to put the boom. I stopped back by the site on my way home and found that Clayton had staked a new absorbent boom down in the shallow containment ditch. He was using a shovel to stir up the oily sawdust in the dike. I told Clayton that he must stay productive with getting this site cleaned up. I said that I will be back by in a couple days.
1519392663 2018-02-22 Production Wells No Violations On the day of my inspection I found that The absorbent pads and boom were still in place and they were relatively clean. The dike was starting to fill up with water from the heavy rain. The water was on the verge of flowing over the front of t he dike wall. I called Clayton King and he was at the site within ten minutes. He opened the dike drain to let some of the water out I watched the flow with him and it was clear water. He closed the valve after the fluid level had come down in t he dike. Clayton said that he was going to get his skid loader to build up the front wall of the dike. I told Clayton that he must keep an eye on this dike with three more days of rain in the forecast.

I spoke to Clayton on the phone and he claimed that now he wants to remove all of the tanks to pull all of the contaminated soil out and rework the dike. 1525872221 2018-05-09 Production Wells No Violations On the day of my inspection I found that the dike was dry and there was a new layer of sawdust spread across the area where the oil has soaked in to the soil. There were still some spots where oil was soaking up into the sawdust. The area below the dike, where Clayton had been draining the rain/snow water out of the dike was tilled up with manure and lime mixed in the soil. All of the absorbent pads had been removed and I did not find any oil coming up through the tilled soil. Clayton had fabricated a water knock-out with a 55 gallon drum to drain the dike water into. It was half full and there were pads floating on the surface of the fluid. Clayton has claimed that he plans to move the tanks further back on the property and completely reclaim the current site.

There was not any new oil in area below the dike where Clayton had been draining the rain water. He had a 55 gallon drum hooked up to his dike drain and configured as a makeshift water knock-out.

1544042113 2018-12-05 Production Wells No Violations On the day of my inspection I stopped at Clayton Kings production tanks to do a long term follow up on the spill clean-up he completed over the summer. I found that there had been no changes at the site since I resolved his compliance notice. He had not put any new gravel into the dike. The dike was dry after recent rain in the area. He had the front built up with soil. I did not find any residual oil that may have re-surfaced over time. I did not find any evidence that his tank has been over run since the clean-up.
1550759429 2019-02-21 Production Wells No Violations I stopped to do a long term follow up on Royalty Enterprises tank battery. There was a tank spill here last year that took months to be resolved. This area has been subject to high volumes of rain and snow over the past few months. On the day of my inspection I found that the dike was full of a 1 to 2 inch layer of snow, ice and water. I did not find any evidence of residual crude oil in the snow and water. There were no new signs of leaking around the tanks or separator.
1574956456 2018-04-23 Production Wells No Violations On the day of my inspection I found that the oil soaked sawdust had not been removed from the dike yet. The lower area below the dike, where Clayton had been draining the rainwater was partially tilled up with horse manure and granulated lime mixed in. I called Clayton and he said that he would be back out today to finish the lower area. He also agreed to get the sawdust out of the dike today.
1664990159 2018-02-05 Production Wells No Violations On the day of my inspection I found that the oily sawdust had not been removed from inside of the dike. The ground was snow covered at the time of my inspection and I did not find any free oil seeping up through the snow. There were no signs that any oil had migrated outside of the containment dike. I called Clayton King to ask what he was doing with the sawdust. He said that he had contacted Kimbles landfill and he was in the process of filling out the application to be added to their customer database. Clayton claimed that he would get the papers turned in this week and as soon as the snow melted off he would get out to the site and get the sawdust shoveled up into 55 gallon drums to be transported to the landfill.
1667733951 2018-03-01 Production Wells No Violations On the day of my inspection I found that the oily sawdust was still in the dike, which was starting to fill up with rain water again. None of the water had ran over the front of the dike wall yet. The absorbent pads and boom were still in the area below the dike. Clayton showed up while I was inspecting the site and he started draining the rain water out of the dike. He claimed that he had removed some of the oily sawdust and moved it to a flat are on his property to be land-farmed. Clayton had more excuses as to why he hasnt gotten the area cleaned up yet, and he made more promises that he would have it done over the weekend. I will continue to check the site and work with Mr. King.

I did not see any signs of oil running out of the sawdust or getting outside of the dike. I called Clayton King and he claimed that his paperwork had been sent to Kimbles landfill. He said that he has not followed up on the application status and he said the sawdust was too frozen to get at. I suggested to Clayton that with all the rain and warmer temperatures he should be able to get it shoveled into the drums.

There was an oily scum over the surface of the water. There had been no more progress made with regards to removing the oily soil and gravel. I called Clayton King to tell him that his dike was filling up with water and he needed to come out. I also requested that he put new, clean pads down before he tries to drain any of the water out. He said that he would be out this afternoon. I took more photos to document his progress.

2079623633 2018-02-20 Production Wells No Violations On the day of my inspection I stopped by Clayton Kings tanks to check on the clean-up progress now that the snow has melted off. I found that none of the oil soaked sawdust had been removed from inside of the dike. The dike was relatively free of fluid considering the amount of snow melt and recent rain in the area. There was a small pool of water near the front of the dike by the access road that had a slight sheen where the oil was starting to run out of the sawdust. I did not see any signs that it had ran over the front of the dike, but I did find an open ended 1-inch diameter plastic line protruding out of the dike wall that was draining oily water into open flat area below the dike. There was a new valve sitting on the ground next to the open line. There was a string of well casing on blocks in the open area and there were water channels cutting through the area, from under and around the casing. The channel nearest to the dike was black with oil and there were absorbent pads spread throughout. There was a small pool of oil collecting under the plastic line. The landscape beyond the open area was marshy and grown up in cattails. There were two vernal pools and a small stream that drained into a roadside ditch. I did not find any sheen or visible oil scum in either pool, or the stream. I did observe some amphibian and invertebrate activity in the pools. I collected a water sample from the pools to test for contamination with a Quantab test strip, and the strips did not show any chlorides. I also used a Quantab in one of the water channels that had not been exposed to the oil. That strip showed less than 250 parts per million. Clayton Kings daughter showed up while I was inspecting the site and she inserted the new valve in the open dike drain to stop the flow. I spoke with Clayton on the phone and he claimed that hes had that drain in place for years, and he was just recently using it to drain the snow melt and rain water out of the dike.
