| A follow-up inspection to Notice of Violation and Compliance Agreement Schedule revealed that identification has now been placed at the well and storage tank.  However, there is still no pressure on the annulus.  Prior to this inspection, a 7/14/2009 meeting had been conducted with both Mr. Doug Kitchen, the well owner, and Mr. Ron McBride, Chieftain Energy Contractor.  During the meeting a Compliance Schedule was agreed upon by both parties.  The deadline for compliance was 7/17/2009.  Mr. McBride states that he placed 50 lbs of pressure on the annulus.  Mr. McBride was instructed to check for leaks and again place more pressure on the annulus.

| An inspection was conducted on 7/30/2007 with Mr. Doug Kitchen and Mr. Ron McBride.  During the inspection, it was noted that the dike height along the far end of the constructed dike has not been addressed.  This issue was brought to Mr. Kitchens attention.  It was also noted that the 30mm liner has not been installed.  Mr. Kitchen also states that they would like to build the unloading pad in a different location and utilize different size tanks.  He was instructed to reflect these changes on his design and submit this information to Mr. Tom Tomastik.  Mr. Kitchen was again informed that this site would require fence placed around the facility, and a plastic tank (vault) will not be allowed.  He was instructed to use a concrete vault that is coated.  More work will be needed to complete the construction of this facility.

| A follow-up inspection to NOV and Compliance Agreement Schedule revealed that the previously noted violations have now been resolved.  During the inspection, it was noted that oil exists inside the earthen dike at the storage tank location.  Old and fresh oil on surface of water throughout dike.  Old pads were observed on one end of the dike and will need replaced.  The source of release is from the overflow of storage tank.  Oil stains were observed from top of tank to ground surface, in dike, on two separate ends.  A plug will be recommended for open PVC drain at the unloading pad to prevent overflow of concrete vault.  Note: PVC routed from drain to concrete vaultRemedial Restoration will be recommended for the Spring, due to erosion at well location and along lease roadAt 10:48 am, the well owner, Doug Kitchen, was notified on location, by telephone of inspect results and deficiency with non-related well.  Mr. Kitchen states Ron McBride will cleanup P&C this weekend; agreed that Remedial Restoration work needed and will apply seed.  He was instructed to perform work when the weather drys, but before JuneMr. Kitchen agreed that a plug for PVC drain is a good idea.

| On 9/4/2010, a complaint was received by the DMRM alleging that Mr. Doug Kitchen, President of Chieftain Energy Corp, had dumped pit water onto this lease road on 9/3/2010.  The complainant observed normal lease road condition the morning of the 3rd, but later that evening would see a noticeable change.  The complainant states that Mr. Kitchen had been hauling fluid from drilling location of Permit No. 3595.  An inspection revealed that the entire lease road measuring approx 1000 x 10 contained brine and pockets of oil.  The road surface was silted/smooth resembling a ground surface after applicaion of fluid.  A change in the road condition began at entrance, into ERP, just past the gate.  A puddle measuring approx 5 in width reached maximum units on Low Range Quantabs.  At the ERP location, fresh oil was observed throughout the inside of earthen dike.  The source is from 200 bbl horizontal tank, which has overflowed.  The tank was wet at top on both ends.  At Permit No. 3595 location, spoke with Mr. Jim Kilbarger, Logan Gas (partnership), and Dave Barry with Petroleum Development Corp., regarding fluid hauled from Permit No. 3595.  Both individuals confirmed Chieftain Energy hauled fluid from this location.  Mr. Kilbarger states approx 6 loads were hauled from the blow pit.  He further stated that Mr. Kitchens water truck broke down on Sunday, 9/5/10.  Left message for Mr. Kitchen on cell phone at 11:45 stating to return call as soon as possible.  Mr. Kitchen returned call at 3:29 p.m. and stated so whats this I hear about a problem with me putting water on my lease road for dust control?  Mr. Kitchen was then advised that this activity is not allowed per SB 165.  Furthermore, he does not even have a Brine Resolution Plan with the UIC section.  Mr. Kitchen was given the telephone number for Mr. Robert Stonerock, South Region Oil & Gas Supervisor.  Mr. Kitchen stated that tomorrow he would bring a dozer out and backblade the road.  Mr. Kitchen was instructed not to

A scald area was observed outside the containment dikes. Approximately 75 by 3. Soil was field tested for chlorides. High range Quantab was maxed out at 6508 ppm Cl. I called Bill Diebel and he came out to the well site. I told Bill that the contaminated area must be remediated. The unloading pad sump had overflowed as well. I told Bill that the sump needs to be upgraded to prevent surface water from flowing into the top of the sump pit. I called Dave Poling and discussed the sump pit issues and what was needed to remediate the contaminated areas. I told Dave that the sump must be one piece construction with the top extending at least 6 above the ground level.

The unloading pad sump had overflowed as well. I told Bill that the sump needs to be upgraded to prevent surface water from flowing into the top of the sump pit. I called Dave Poling and discussed the sump pit issues and what was needed to remediate the contaminated areas. I told Dave that the sump must be one piece construction with the top extending at least 6 above the ground level.

Both containment dikes have oil and water in them. Both containment dikes have oil covered leaves and debris. Remove oil, water and contaminated debris from the containment dikes.  The unloading pad containment vault has contamination around the top of the vault. Remove the contaminated material. All solids that are removed must be taken to an EPA approved land fill for disposal. The unloading pad drain has a screw in plug that is blocking the drain. Remove the plug and allow the containment pad drain to function as designed.

| On 9/4/2010, a complaint was received by the DMRM alleging that Mr. Doug Kitchen, President of Chieftain Energy Corp, had dumped pit water onto this lease road on 9/3/2010.  The complainant observed normal lease road condition the morning of the 3rd, but later that evening would see a noticeable change.  The complainant states that Mr. Kitchen had been hauling fluid from drilling location of Permit No. 3595.  An inspection revealed that the entire lease road measuring approx 1000' x 10' contained brine and pockets of oil.  The road surface was silted/smooth resembling a ground surface after applicaion of fluid.  A change in the road condition began at entrance, into ERP, just past the gate.  A puddle measuring approx 5' in width reached maximum units on Low Range Quantabs.  At the ERP location, fresh oil was observed throughout the inside of earthen dike.  The source is from 200 bbl horizontal tank, which has overflowed.  The tank was wet at top on both ends.  At Permit No. 3595 location, spoke with Mr. Jim Kilbarger, Logan Gas (partnership), and Dave Barry with Petroleum Development Corp., regarding fluid hauled from Permit No. 3595.  Both individuals confirmed Chieftain Energy hauled fluid from this location.  Mr. Kilbarger states approx 6 loads were hauled from the blow pit.  He further stated that Mr. Kitchen's water truck broke down on Sunday, 9/5/10.  Left message for Mr. Kitchen on cell phone at 11:45 stating to return call as soon as possible.  Mr. Kitchen returned call at 3:29 p.m. and stated "so what's this I hear about a problem with me putting water on my lease road for dust control?"  Mr. Kitchen was then advised that this activity is not allowed per SB 165.  Furthermore, he does not even have a Brine Resolution Plan with the UIC section.  Mr. Kitchen was given the telephone number for Mr. Robert Stonerock, South Region Oil & Gas Supervisor.  Mr. Kitchen stated that tomorrow he would bring a dozer out and backblade the road.  Mr. Kitchen was instructed not to perform this activity, as this would not be an accepted cleanup therefore, avoid having to address impacted area twice.  Advised him to speak with Mr. Stonerock.  Returned to the location to obtain soil samples and observed Chieftain Energy employee, on dozer, grading section of road near entrance.  Notified Mr. Stonerock of activity by telephone.  Traveled back to ERP location and noted that the entire lease road has now been graded.  Mr. Kitchen states that he told Mr. Stonerock of incident and it was only freshwater.  Asked if Mr. Stonerock told him to grade the road, he replied no.  Mr. Kitchen replied by saying he has five (5) felony charges (non-Oil&Gas related) and does not want anymore problems.  Further stating he is pissed someone turned him in for placing freshwater on his road.  He would then admit, in same sentence, there would have been mixture in the truck, because you could see the brine on the road.  When asked why he proceeded to grade road, Mr. Kitchen replied that he wanted to stay ahead of me.

| An inspection was conducted on 7/30/2007 with Mr. Doug Kitchen and Mr. Ron McBride.  During the inspection, it was noted that the dike height along the far end of the constructed dike has not been addressed.  This issue was brought to Mr. Kitchen's attention.  It was also noted that the 30mm liner has not been installed.  Mr. Kitchen also states that they would like to build the unloading pad in a different location and utilize different size tanks.  He was instructed to reflect these changes on his design and submit this information to Mr. Tom Tomastik.  Mr. Kitchen was again informed that this site would require fence placed around the facility, and a plastic tank (vault) will not be allowed.  He was instructed to use a concrete vault that is coated.  More work will be needed to complete the construction of this facility.

| A follow-up inspection to NOV and Compliance Agreement Schedule revealed that the previously noted violations have now been resolved.  During the inspection, it was noted that oil exists inside the earthen dike at the storage tank location.  Old and fresh oil on surface of water throughout dike.  Old pads were observed on one end of the dike and will need replaced.  The source of release is from the overflow of storage tank.  Oil stains were observed from top of tank to ground surface, in dike, on two separate ends.  A plug will be recommended for open PVC drain at the unloading pad to prevent overflow of concrete vault.  Note: PVC routed from drain to concrete vault.  Remedial Restoration will be recommended for the Spring, due to erosion at well location and along lease road.  At 10:48 am, the well owner, Doug Kitchen, was notified on location, by telephone of inspect results and deficiency with non-related well.  Mr. Kitchen states Ron McBride will cleanup P&C this weekend; agreed that Remedial Restoration work needed and will apply seed.  He was instructed to perform work when the weather drys, but before June.  Mr. Kitchen agreed that a plug for PVC drain is a good idea.

0031053836 2007-07-30 Surface Facility Construction No Violations An inspection was conducted on 7/30/2007 with Mr. Doug Kitchen and Mr. Ron McBride. During the inspection, it was noted that the dike height along the far end of the constructed dike has not been addressed. This issue was brought to Mr. Kitchens attention. It was also noted that the 30mm liner has not been installed. Mr. Kitchen also states that they would like to build the unloading pad in a different location and utilize different size tanks. He was instructed to reflect these changes on his design and submit this information to Mr. Tom Tomastik. Mr. Kitchen was again informed that this site would require fence placed around the facility, and a plastic tank (vault) will not be allowed. He was instructed to use a concrete vault that is coated. More work will be needed to complete the construction of this facility.
0040479472 2010-03-12 Enhanced Recovery Project No Violations A follow-up inspection to NOV and Compliance Agreement Schedule revealed that the previously noted violations have now been resolved. During the inspection, it was noted that oil exists inside the earthen dike at the storage tank location. Old and fresh oil on surface of water throughout dike. Old pads were observed on one end of the dike and will need replaced. The source of release is from the overflow of storage tank. Oil stains were observed from top of tank to ground surface, in dike, on two separate ends. A plug will be recommended for open PVC drain at the unloading pad to prevent overflow of concrete vault. Note: PVC routed from drain to concrete vault. Remedial Restoration will be recommended for the Spring, due to erosion at well location and along lease road. At 10:48 am, the well owner, Doug Kitchen, was notified on location, by telephone of inspect results and deficiency with non-related well. Mr. Kitchen states Ron McBride will cleanup P&C this weekend; agreed that Remedial Restoration work needed and will apply seed. He was instructed to perform work when the weather drys, but before June. Mr. Kitchen agreed that a plug for PVC drain is a good idea.

0091643873 2008-11-26 Surface Facility Construction No Violations An inspection was conducted to ensure that the concrete vault was properly coated with tar. Witnessed Chieftain Energy employees coat the inside walls of the vault. The bottom (inside) of this vault contained ice therefore, not allowing the application of material. The company therefore, removed the ice and will allow the bottom to dry.
0102072007 2015-09-23 Enhanced Recovery Project No Violations Chief Order # 2015-445 follow up inspection. Both containment dikes have fluid in them. No equipment is on site to remove contaminated material. An additional scald area was observed along the access road at GPS N39.48989 / W082.39777. The scald area is roughly a triangle shape that flows into the wood line. Dimensions are 34 by 26 by 44. This area is stained dark and is completely devoid of vegetation. A field test of the soil revealed 2930 ppm Cl.

Andy has contacted the company regarding the water in the dike and the needle valve.

The line did not pass the reqiured test, due to leakage from two points above ground near test gauge location on end. Test Data: 780 psi at 1:29 p.m. to 705 psi at 1:32 p.m. (leak @ split connection near gauge). Attempt to tighten and re-test. Re-pressured to 730 psi @ 1:36 p.m. and pressure still continued to drop. Second leak near end of line after check valve. Will re-test next week. The check will be removed for next test.

Both containment dikes have water and oil in them. Capacity in containment dikes is reduced to at least half of the required amount. The 300 barrel tank and the 210 barrel tank show signs of over flowing on the sides. The roll off box has been removed from the location. Oil residue and a narrow scald area was observed where the roll off box was located. The contaminated area outside of the containment dikes was delineated and 4 soil samples were collected (3 from the contaminated area and 1 control sample). Soil samples were taken to the ODNR Lab.

During the inspection, it was noted there is no pressure on annulus, and oil and brine inside dike. Absorbent pads were also observed inside the dike. The concrete vault was full of fluid and appears to have overflowed, as Cl- was observed in standing water around the area. The unloading pad contains open hole for drainage to vault (PVC pipe). The installation of a cap to prevent overflow from rainfall events will be recommended to company.

0278715626 2010-09-07 Brine Hauler Violations Noted On 9/4/2010, a complaint was received by the DMRM alleging that Mr. Doug Kitchen, President of Chieftain Energy Corp, had dumped pit water onto this lease road on 9/3/2010. The complainant observed normal lease road condition the morning of the 3rd, but later that evening would see a noticeable change. The complainant states that Mr. Kitchen had been hauling fluid from drilling location of Permit No. 3595. An inspection revealed that the entire lease road measuring approx 1000 x 10 contained brine and pockets of oil. The road surface was silted/smooth resembling a ground surface after applicaion of fluid. A change in the road condition began at entrance, into ERP, just past the gate. A puddle measuring approx 5 in width reached maximum units on Low Range Quantabs. At the ERP location, fresh oil was observed throughout the inside of earthen dike. The source is from 200 bbl horizontal tank, which has overflowed. The tank was wet at top on both ends. At Permit No. 3595 location, spoke with Mr. Jim Kilbarger, Logan Gas (partnership), and Dave Barry with Petroleum Development Corp., regarding fluid hauled from Permit No. 3595. Both individuals confirmed Chieftain Energy hauled fluid from this location. Mr. Kilbarger states approx 6 loads were hauled from the blow pit. He further stated that Mr. Kitchens water truck broke down on Sunday, 9/5/10. Left message for Mr. Kitchen on cell phone at 11:45 stating to return call as soon as possible. Mr. Kitchen returned call at 3:29 p.m. and stated so whats this I hear about a problem with me putting water on my lease road for dust control? Mr. Kitchen was then advised that this activity is not allowed per SB 165. Furthermore, he does not even have a Brine Resolution Plan with the UIC section. Mr. Kitchen was given the telephone number for Mr. Robert Stonerock, South Region Oil & Gas Supervisor. Mr. Kitchen stated that tomorrow he would bring a dozer out and backblade the road. Mr. Kitchen was instructed not to

0359615844 2015-12-31 Enhanced Recovery Project No Violations Chiefs Order # 2015-445 Follow up inspection. The containment dike has over 18 of water in it. The injection tubing is not connected to injection equipment. The master valve is closed. Checked the annulus pressure which was at zero pressure with fluid observed at the surface when the gauge was removed. There has been no effort to complete the remediation of the contaminated soil.
0371501340 2013-01-10 Enhanced Recovery Project No Violations Checked injection and annulus pressures. There was fluid in both containment dikes. Where the liner had been added to on one of the containment dikes the adhesive tape was not holding. The vault the held fluid from the unloading pad had over flown. One of the tanks had also over flown and oily material was left in the dike. Mr. Bill Deible was called and he came out to the site. These issues and their remedies were discussed. We also discussed their sump system and the way it was plumbed. Inspector Jon Scott was also on site. He will be issuing the Compliance Notice. Flowmeter displays information in gallons.

Chieftain Energy has been sent a NOV and also verbally instructed on several occassions in regards to positive pressure on annulus. Hocking Hills Energy is using their vac truck to remove the water from the roll off box. Both containment dikes have water and oil in them. The dikes are being cleaned using the UST truck and labor. Doug Kitchen is operating the trac hoe and has removed the unloading pad and unloading pad sump. This material along with additional excavated contaminated soil is being placed in roll off containers and shipped to the landfill. All injection equipment and valves are shut off. Dike has had recent oil in dike and oil has flowed to top of the lowest portion of dike. A new sump pump has been installed in both dikes and concrete vault for unloading pad. Inspection of the well revealed slight vacuum on the annulus. Doug Kitchen was notified in person at the well site that he needs to test the annulus to the maximum injection pressure for 15 minutes. Doug was also notified that he needs to replace the 1/4 injection fitting. (threads are stripped out.)

1712197945 2010-05-14 Enhanced Recovery Project No Violations A follow-up inspection revealed non-compliance. Arrived at the location and met with Chieftain Energy Contractor, Mr. Ron McBride. The pressure on the injection line from tank to well (disconnected) was at approximately 400 psi and dropping. At this time, Mr. McBride is unable to achieve the required maximum injection pressure of 675 psi to test line. Mr. McBride states that the line is full, but the pump will continually shut down. He was instructed that injection is not allowed at this time. The line must pass the required test prior to injection. The dike has been pumped and nearby gas line from non-related well has now been repaired. Informed Mr McBride that well site and lease road need to be graded.
