0006847816 2009-11-16 Production Wells No Violations An inspection revealed a 3/4 diameter black plastic line attached to bottom of 35 bbl tank and routed over hillside. The line contains a 3/4 gate valve attached on the end. Note: The load line is routed uphill in opposite direction. The valve was closed at time of inspection. The 35 bbl tank appears to have overflowed from top, as oil observed on ground surface with absorbent pads. The well owner will contacted regarding the inspection results. The well owner has yet to register with the Division.

I informed Ray of a small spill that occurred from a cracked gas line where it enters into a horizontal separator. The spill is approx. 5 wide and 16 feet long. He is not using the well for gas. The well has no motor on it therefore it is not capable of production. Mr. Hartman stated he did not own the property or the well. Previous documentation showed he is the unregistered owner. I will be doing father research to aid in getting the well into compliance.

He stated that he has nothing to do with the well, and that the well was willed to a Mr. Lemay. He also stated that he no longer uses the well to heat his bar. Further investigation at the courthouse showed that Mr. Hartman does indeed own the well, and that Mr. Lemay owns only the surface. No identification on well head or tank battery. Annual production statement not filed. Statements showed no production at all. Mr. Hartman is also a non-registered well owner. Paperwork needs to be sent to Columbus to show well ownership.

The letter was sent by Regional Manager Dan Goins sent a letter to Ms. Annette Booth because she is power of attorney for Ray Hartman. This well had pollution and contamination in the past. Inspector Brent Bear was able to determine the well ownership was Ray Hartman. At that time, Ray Hartman admitted ownership and proceeded to clean up the pollution and contamination. The reason for the letter was to inform Ms. Booth that there is pollution and contamination currently that needs cleaned up. Ms. Booth told me she nor her farther had the funding to clean up the oil spill. I also informed Ms. Booth of the requirement to take ownership of the well.

During the meeting, Mrs. Booth confirmed her fathers ownership of the well. Mrs. Booth states that the sole source of heat for the bar is from the well. The apartment above the bar does receive gas from the well, but not primary source. Mrs. Booth was informed that her father would not be considered an exempt domestic well owner. Explained the procedures for registering with the DMRM, as a well owner and provided the required forms with attached instructions for non-exempt ownership. We also discussed contamination and pollution at the location to include proper disposal of brine. Mrs. Booth was informed that the 100 bbl tank is leaking and she then talked about spoke of potential tank replacement. She states that they would pump out the dike. Absorbent Pads were recommended for the well location if oil were to resurface. I mentioned that oil pools should have been cleaned up before burial. Bioremediation mentioned for soil at the tank battery.

Mrs. Booth states that they do not have the money. Recently, her mother provided financial assistance to avoid foreclosure on the house. She was informed that if they do not have the money to register, the well would have to be plugged. A second option would be to transfer the well to a registered well owner. 0631547645 2015-01-21 Production Wells No Violations I arrived on location to find the well equipped with a pump jack. There was a 1 plastic line connected to a drip tank which is split at the tank side and emitting gas. This split in the line is allowing oil to escape and drip onto the ground. The area of contamination was roughly 18 X 20. The line runs up to the Zaleski Tavern. Inspector Kip Thompson arrived on location and will follow-up on the compliance action and cleanup process of the area once he gets in contact with Ray Hartman, the tavern owner and party responsible for previous contamination issues at this well..

0747706873 2009-04-28 Production Wells No Violations A follow-up inspection revealed that the well owner, Mr. Ray Hartman, is making an attempt to achieve compliance. An empty wheel barrel and a shovel was observed at the location. At the time of the inspection, no work was being performed. After a closer observation of the immediate area surrounding the well, it was noted that the pooled oil and bare areas has now been covered up with dirt. The soil showed signs of oil beneath and on the surface. Quantabs were placed, in the fluid observed at this location. High Range Quantabs (Titrators for Chloride) were utilized at two locations near the well. At the first location, the Titrator showed a unit value of 9.2. A unit value of 8.2 equals 6465 ppm (mg/l) Cl-. At the second location, the Titrator showed a unit value of 7.6, which equals 4783 ppm (mg/l) Cl-. Mr. Hartman will be contacted regarding the cleanup procedure and DMRM recommendations. Photographs were obtained from this inspection.

0933898961 2009-04-30 Production Wells No Violations A follow-up inspection to Chiefs Order was conducted. At the time of the inspection, two gentlemen were observed at the well site shoveling dirt over areas impacted by contamination and pollution. The two gentlemen stated that they are helping out Mr. Ray Hartman with cleanup by covering up these areas. Spoke with Mr. Hartman about the cleanup and explained to him that we would have liked to have seen the pools of oil removed with diapers before burying with dirt. Further stated that this would eliminate any possibility of oil re-surfacing. Bioremediation was explained to Mr. Hartman and that we could apply horse manure, lime, seed and mulch to the impacted areas. He agreed that he could afford to do this procedure. Again informed Mr. Hartman that there is a hole in the bottom of his 100 bbl tank. He confirmed this deficiency and further stated that he does not have a lot of money and would like to abandon the well by removing the motor and just let it sit. Explained to Mr. Hartman the requirements for properly abandoning the well and that he would need to register, apply for plugging permit, locate a service rig. The plugging activity would be witnessed by the Division. The second option that we discussed was the possibility of selling the well to another company.

1115074561 2009-07-13 Administrative Inspection No Violations At 4:40 PM, a telephone call was placed to Mrs. Annette Booth, Mr. Ray Hartmans Daughter, 740-596-4925. No answer. Therefore, a voice mail message was left stating for her to contact me in regards to this well. My cell phone number was also provided. Mrs. Booth returned my call at 5:38 PM. Mrs. Booth states that her dad does not own the property that the well is situated on. Furthermore, he only owns the lease because it was tied in with the bar. She was informed that he has been operating/pumping the well, and has verbally confirmed ownership of the well to me. Moreover, the language in paperwork obtained from the Vinton County Courthouse confirms that he is the well owner. A meeting was setup with her for 7/20/2009 to discuss registering with the DMRM as a well owner. Mrs. Booth was informed of the fluid and oil inside the dike. Absorbent pads could be used to retrieve oil or pumped to remove brine. She was informed that the 100 bbl tank further described as the bigger tank on top of hill contains a hole in bottom. Mrs. Booth asked what could be done. She was told that tank could be flipped, but would depend on topside condition. She states that they could look for a new tank. Also mentioned contaminated areas around well site had been buried, which may potentially resurface.

The enforcement process was explained to Mr. Hartman to ensure that he understood the consequence of his action. Mr. Hartman was also asked if he had any plans to resolve the violations and how much longer it would take. Mr. Hartman states that his health and financial situation is not very good, but would make attempt to resolve this issue within a month.

No work has been performed to remove contamination. Old and fresh oil was observed around the wellhead. Bare areas still exist around the well site including area located downhill from the tank battery. Oil still remains at top of the hill around 100bbl tank. Old crude oil observed on the discharge side of the drainage culvert, which appears to have broken down. The drainange culvert from this intermittent stream leads to Raccoon Creek located approximately 300 feet away. Photographs were obtained from this inspection.

1238754936 2017-05-03 Production Wells No Violations Altier Brothers is on site to remove the contaminated soil and equipment that was associated with the leak. They used a skid steer to remove the soil and it was placed into a dump truck The soil will be taken to the Hocking Athens landfill for proper disposal. The well head was made safe by placing new packing rubbers in the stuffing box and plugs on the casing. One side of the casing has a plug. The other side of the casing has a 2 inch diameter valve with a plug. The site was graded, seed and straw were applied to prevent erosion.

Spoke with Mr. Riggs about earthen dike for tank battery and well head locations. Mr. Stonerock instructed both parties that the soil was to be removed from inside dike and bioremediation could be performed. Bioremediation could also be performed at the well location.

Ran quantab titrator tests on the water in the dike and the water dripping from the load line valve. There were no chlorides in the dike water, but the water from the load line valve maxed the high range titrator out. Pictures were taken on this date.
1337192469 2012-05-09 Production Wells Violations Noted Upon arrival, the first thing I noticed was that there was a puddle of crude oil under the pumping unit. After that, I noticed that one of the check valves was leaking gas, there were bare spots on the ground, the drip tank had residual oil around the cleanout valve, and the valve on the oil tank was still leaking. I spoke with an employee of the Zaleski Tavern, and she stated that Mr. Ray Hartman had told her that he didnt own that well. She said a man named Lemay owned it. I then explained to her that as a result of my courthouse search, the property went to Mr. Lemay but the well was still in Mr. Hartmans name. I gave her my card and asked her to have Mr. Hartman call me.

1491497052 2017-04-06 Production Wells No Violations Compliance notice follow-up. No effort has been made to bring the well into compliance. The 1 inch diameter plastic line that is feeding gas and crude oil into a used hot water tank is still cracked. The line is still leaking gas and crude oil. The length of the spill has increased from approximately 57 feet long to approximately 61 feet long. The oil spill is approximately 23 feet from entering a water course. New photographs were taken during my inspection.
1493142083 2017-04-25 Production Wells No Violations I received a call from Mr. Benny Altier at 12:33 PM on 4-25-2017. Mr. Altiers company was awarded the bid to clean up the pollution and contamination. Benny expressed concern that the spill had grown larger than what his bid would allow for the clean up. The spill has grown in length to approximately 70 feet in length, the spill was approximately 65 feet in length at my last inspection on 3/20/2017 and remained approximately 5 feet in width. I called Benny back and told him I compared my pictures with prior pictures and did not believe the spill has grown enough to warrant any additional costs. Benny agreed and is scheduled to begin the work on 4-27-2017. New photographs were taken during my inspection.
1495462441 2017-05-22 Production Wells No Violations Production well inspection. The contamination from the oil spill has been removed. The wellhead that was secured remains liquid tight with no leaks. The grass is growing to prevent erosion.
1510683584 2007-02-20 Production Wells No Violations FOLLOW UP TO NOV # 839563169 An inspection revealed contamination and pollution. An accumulation of old and fresh oil was observed around the well to include pumping unit. 2 x 4 has been placed near well head location, due to depth of fluid containing oil. Bubbling observed at this location. Facing north, bare area(s), old and fresh oil travel from 100 bbl tank, leaking rectangular tank and well towards the east and to the stormwater drain. At the tank location, on top of hill, fluid and oil were observed inside the dike and over the hillside. Note: Stormwater drain bends around property and drains into Raccoon Creek approx 300 away. The well is located approx 50 away from a section with runoff observed in south direction. Overall impact approx 75-100 x 5-50. Records indicate historical owner therefore, nearby residents were interviewed to inquire about well ownership. It was found that this well is owned by Mr. Ray Hartman, owner of the Zaleski Tavern, PO Box 206, Zaleski, Ohio, (740) 596-2629. Mr. Hartman was instructed to fix problem and haul contaminated soil taken to an EPA landfill.

1549652926 2009-03-25 Production Wells Violations Noted Accompanied by Mr. Mike Sherron with Ohio EPA to conduct follow-up inspection to Chiefs Order. The inspection was conducted during a rainfall event. It was noted that no action has been taken to resolve the violations. An oil sheen was not observed in the stormwater drain or at discharge side to Racoon Creek. Mr. Brent Bear and Mr. Mike Sherron located the well owner, Mr. Ray Hartman. Mr. Hartman was informed by Mr. Sherron that the contamination and pollution from his well site potentially threatens waters of the State. He was verbally instructed to cleanup the well site within 60 days and issued a Field Notice of Violation. Mr. Hartman was also verbally informed that his 100 bbl tank contains a leak at bottom.
1581687530 2015-01-22 Production Wells No Violations I arrived at the Zaleski tavern at 0830hours. I was told the well owner Ray Hartman also owns the tavern. I waited for Mr. Hartman to leave his business. He did not in the time I was thee. I called Mr. Hartmans daughter Annette Booth regarding the contamination that need cleaned up.

1652117778 2017-01-24 Production Wells No Violations Production well inspection. The well consists of a pumping unit that is missing the counter weight and 1-50 barrel tank. There is a 1 inch diameter plastic line coming from the wellhead. This line is plumbed into a small steel tank. The oil leak is caused by a crack in the 1 inch diameter line were is plumbed into the steel tank. Fresh oil is evident on the steel tank The spill is approx. 45 feet long by 5 feet wide. I notified ODNR emergency response and district supervisor Eric Conrad of the size of the spill. New pictures were taken during my inspection.
1739445931 2007-08-10 Production Wells No Violations A follow-up inspection revealed non-compliance. Fresh oil appears to have been released from a rectangular tank located at the top of the hill. The oil was also observed at bottom of the hill. No work has been done to remedy the deficiencies. Constant bubbling still observed at the well head. Again verified that the bubbling is not from a broken gas line. The source appears to be from well head. The oil and water surrounding this well is very deep which makes it hard to get a closer look at the well head. New pictures were taken during this inspection.

The valve on the 1 plastic that is hooked to the casing is open and allowing oil to escape the 1 plastic line. The 1 plastic line is hooked into a old hot water tank The plastic line is cracked where enters into the hot water tank. The spill size will allow the oil to enter into a water course in a short amount of time. New pictures were taken and shared with Regional Supervisor and ODNR legal section.

Old and fresh oil was observed during the inspection. The intermittent stream that leads to Racoon Creek was inspected for visual contamination. No sheen or signs of oil were observed near the well. Downstream of the location, on the discharge side into Racoon Creek, old oil was observed to have broken down. Mr. Ray Hartman has not contacted the Division since the last inspection. A business card had been left for Mr. Hartman.

2117791000 2017-03-21 Administrative Inspection No Violations Myself, Regional Supervisor Dan Goins and District Supervisor Eric Conrad met in Nelsonville Ohio. The purpose of the meeting was to meet with Annette Booth. Annette Both is the daughter of Ray Hartman and is the power of attorney for Ray Hartman. According to courthouse records, Ray is the owner of this well. The well has caused pollution and contamination. The oil spill is 57 feet long and approximately 5 feet wide. The 1 plastic line that is hooked to the casing is causing the leak. I called Annette at 10:05 AM and asked if she would be able to meet us. Annette agreed to meet us and arrived at 10:12 AM. We discussed the fact the well has caused pollution and contamination. Annette stated her father is on a limited income and did not have the money to perform the clean up. Annette also stated she did not have the money to clean up the pollution and contamination. We informed Annette the State of Ohio ODNR Division of Oil and Gas would hire a contractor to perform the clean up and she would be responsible for paying the bill. Annette was also told the State could place a lien on the property. Annette stated she would sign over the property to the State of Ohio as she had no ability to pay for the clean up.
