-1153719454 2009-10-26 An inspection revealed that the AD line has now been connected to the well. The P&C from observed discharge on 10/23/2009 has been covered up with dirt. High Range Quantabs placed in fluid outside dike along lease road revealed 9.6 units which exceeds 6545 ppm (mg/L) Cl- for 8.4 units. Checked tank battery located off Skinner Rd (on top of hill) and found that valve on bottom of 100 bbl is still open.
1256837408 2009-10-23 An inspection was conducted to check status of AD connection. Note: Rainfall event today. The 2 black plastic AD line was disconnected and placed inside earthen dike around well head. The valve was 3/4 open allowing brine and oil to be released onto ground surface. Fresh oil pooled on surface to include oily gravel. The fluid inside dike exceeded maximum High Range Quantab units (10). Note: 8.4 units and equal to 6545 ppm (mg/L) Cl-. Quantabs placed outside the dike ranged from 1079 to 1283 ppm (mg/L) Cl-. Samples were obtained from this inspection. The 2 line is routed from the tank battery for Permit 2211 and 2212 located off Skinner Road approx 1/2 mile away. The valve on the 100 bbl saltwater tank battery was observed open. Report continuted on next page. On 10/23/2009, an unauthorized dishcarge of brine and oil onto ground surface was observed from a 2 AD line. Fresh oil and brine observed on ground surface inside dike. Brine also observed outside the dike along lease road. The burial of contaminated
1257188614 2009-10-23 10/23/09 Report Cont: South Region Oil & Gas Supervisor, Mr. Robert Stonerock was notified. At 4:20 pm, a message was left for Mr. Ron McBride on his cell phone regarding well status. Called Mr. Doug Kitchen on his cell phone at 4:23pm, but unable to leave message. At 4:24 pm, I called Mr. Kitchen at his office. He was informed of oil and brine discharge from AD line and to close valve immediately. Mr. Kitchen states he was unaware that valve was open and that Chad is sitting right here and would get it taken care of tonight or Monday. Mr. Kitchen was then instructed to shut off discharge now. Mr. Kitchen responded by saying that he meant that cleanup would be done on Monday and would send Chad to location. Confirmed that discharge derives from tank battery for Permit 2212 and 2211(uphill from location). Informed Mr. Kitchen that AD connection for Permit# 2218 not authorized and to disconnect. He states they will have dozer, would pressure up, change well heads around, and test next week. Waited at location for 1 hour and observed no personnel.

-1558167378 2009-12-10 A follow-up inspection was conducted with Mr. Robert Stonerock, South Region Oil & Gas Supervisor. Reviewed and discussed location and source of illegal brine disposal onto ground surface as previously noted. Furthermore, reviewed cleanup that had been performed on-site since this time. This case will be reviewed by management for further legal action therefore, the Notice of Violation will be left open. Note: light snow cover at time of inspection.
-1895269874 2009-11-05 A follow-up inspection was conducted with Dan Goins. The well status remains the same as AD remains connected to the well. Called Mr. Doug Kitchen at his office at 9:31 am. Instructed Mr. Kitchen to remove connection today. He states that Mr. Ron McBride is on his way. Mr. Mcbride arrived at location and disconnected the AD line at the well. The valve is closed. Mr. McBride states that he will also close the valve at 100 bbl on the hill and that its empty. Mr. McBride was asked about the AD line from location on hill (near ERP). He states that both him and Doug believe there is a potential for 100 bbl to drain to both Permit 2218 and Permit 2219. Further states they are unsure of setup because it was like this when they bought the wells. Explained to Mr. McBride the areas that will require P&C removal (P&C had been buried).

Observed the placement of soils onto Kilbarger Truck for hauling to landfill. A total of three trips were taken to EPA Approved Landfill. Received 2 run tickets from EPA approved Landfill today, which showed 21.63 tons and 29.49 tons respectively. The third ticket will provided at a later date. New soil, lime, seed and mulch applied to the impacted areas.

-702759094 2009-11-12 Witnessed the excavation of contaminated soils from impacted areas at well location. During the cleanup, two lines were observed leaking underground. Approx 2' below ground along lease road, a 2 plastic line was found leaking brine and oil. This line had been clipped while digging. Filled 4 oz sample bottle in 1 minute. Chieftain Energy Contractor, Mr. Ron McBride states this is the old AD line that had been abandoned. Pulled up line and leaks were no longer observed. High Range and Low Range Quantabs revealed unacceptable Cl- values at test intervals. Dug down approximately 6.5' to remove contamination and pollution and find acceptable soil. Overall depth of soil removed 4'- 6.5'. Overall impacted area along lease road measured 46' x 5'. The second line was 2 steel with elbow found 2' below ground inside the dike around well head. I drip every 10 seconds. The fitting was replaced with a plug. Overall depth of soil removed inside dike was 2'- 3'. The dike measured 20' x 9'. Soil will be hauled to EPA approved landfill tomorrow.

-828072389 2009-10-07 A follow-up inspection revealed that annular disposal has been disconnected. Two lines with valves observed to have been connected to annulus with valves open. The tank battery is shared with Logan Sand #4. One (1) 100 bbl tank with knock-out, a 1000 gal polyeurothane tank, separator and drip. Chieftain Contractor, Mr. Ron Mcbride has been previously instructed to disconnect both wells. Mr. Mcbride also stated that they were going to test. High Range Quantabs placed in fluid along lease road revealed 3.4 and 4.0 units in two separate areas, but located directly across from line and well. Fluid along road at location approx 25' x 5'. Brine disposal line contains valve and observed closed. The line has been placed inside earthen dike around well head at time of inspection. Nearby locations away from higher values showed 1.6 units.
