I was on location with Bill Fitzmartin from M&R Investments at the time of this inspection to confirm the remedial work on the dike has been completed. The dike has been completely installed, all new soil and stone had been previously emplaced within the diked battery and the 100 BBL tank has been reconnected to the mechanical separator. New signage has been installed at the tank battery. I spoke with landowner William Dieterle regarding the site cleanup and closure of complaint. Compliance notice closed. |

1092693560 | 2018-08-21 | Production Wells | Violations Noted | I conducted an inspection on this well regarding complaint #5937 with DOGRM-Emergency Operations Coordinator Fred Romeo. Landowner Mr. William Dieterle stated that a previous release of oil had occurred inside the tank battery and that cleanup efforts had not been done correctly. At the time of this inspection, the well was equipped with a plunger lift assembly and was not in production. The gate valve on the tubing and flow line valve were closed. The tank battery consisted of one 100 BBL tank and a mechanical separator. Valves on the separator were open. The tank battery had standing water and a sheen was observed on the water. The water in the dike was tested with a high range Quantab. No reading was obtained on the Quantab. Soil samples were taken using a soil auger and residual oil was observed in the stone and soil sample. The dike had been cut to release water on the north side, and outside of the diked battery, oily sheen was observed on the standing water. North of the tank battery was vegetated with grass which was observed to be stressed. The signage was located at the tank battery but needed to be updated to reflect the current owner information. Bill Fitzmartin from M&R Investments was contacted regarding the findings of residual oil in the battery and signage. Mr. Fitzmartin stated that a tank did overflow and M&R Investments had intially cleaned the area but needed to come back to the site to finish the cleanup. Mr. Fitzmartin also stated that landowner Mr. Dieterle would not allow M&R access to his property to complete the cleanup activities.
M&R Investments needs to: 1) Cleanup the water and residual oil within and adjacent to the tank battery 2) Dispose of properly any impacted soil/stone within and adjacent to the tank battery 3) Install signage |

At the time of this inspection, landowner, William Dieterle requested an inspection of the well and tank battery. Mr. Dieterle stated that the previous cleanup efforts from a tank release into the tank battery by M&R Investments, was not done properly. There was not an active leak at the time of this inspection. The well was equipped with a plunger lift assembly and not in production at the time of this inspection. The tank battery consisted of one 100 BBL tank and a mechanical separator. Inside the diked battery, standing water was noted. A high range Quantab test was taken of the water and no chlorides were present. Mr. Romeo used a soil auger to gather samples of the soil and stone within the battery. Residual oil was present each time the soil/stone medium was sampled with the soil auger. The north side of the dike needed to be rebuilt. The area north of the dike showed some stressed vegetation. Bill Fitzmartin from M&R Investments was contacted with regards to the tank battery condition and findings of the residual oil. Mr. Fitzmartin stated that the company would come out to the site and assess what cleanup would need conducted. Informed Mr. Dieterle that M&R Investments would come out to the site and conduct cleanup accordingly. |

The remedial work that was conducted at the tank battey location consisted of removing the 100 BBL tank out of the battery. The tank was checked for integrity and found to be intact and the bottom integrity of the tank had not been compromised. Removal of the existing stone and soil that contained the residual oil was placed into a truck to be offloaded at a proper disposal facility. New soil and stone was emplaced into the tank battery and the dike was partially rebuilt. More soil was needed to complete the dike and the reattachment and installation of the 100 BBL tank would also need to be completed. I spoke with landowner William Dieterle on location and kept him apprised of the ongoing cleanup activity throughout the day. I will return the following day, 10/11/2018 to conduct another inspection once the cleanup has been completed. |
