Talked to Bill Mitton and he is planning on installing two 100 barrel steel tanks in a new dike. An under flow containment dike has been constructed between the 300 barrel tank and the creek to capture residual oil.
0240428073 2012-05-14 Drill / Deepen / Reopen Violations Noted Oil spill in Buckeye Creek. Oil spill caused by pumper over flowing the 300 barrel horizontal tank. Tank dike was constructed into hillside with no surface water diversion. Dike was shallow with uneven sides. Tank is located 31 feet from edge of Buckeye Creek. Tank overflowed into dike filled with fresh water (from recent rain event). Oil flowed 152 feet over lease road and on the ground into Buckeye Creek. Spill was not reported to Division of Oil and Gas or to OEPA. I called OEPA after receiving a call from local contractor at 11:10 am 5-14-12. Spill was found at 6 pm on 5-13-12. Clean up oil on ground and in Buckeye Creek. Drain tank and relocate at least 50 feet from Water way. 1501:9-9-05 (A)(9) Build dike around storage tanks which have the capacity sufficient to contain any substances resulting, obtained, or produced in connection with the operation of the related oil or gas well. No identification at well or tank. 1501:9-9-05(A)(10) All producing leases shall be legibly identified as to owner, lease name, well number, permit number, county, and an emergency telephone number. Well is in production for oil and is venting gas to the atmosphere. 1501-9-9-05(B) All gas vented to the atmosphere must be flared. Verbal compliance notice was given in field to Terry Wade and Bill Mitton (Phone call) on 5-14-12.

1337169646 2012-05-14 Production Wells No Violations Oil spill. Received a call at 11:10 am on 5-14-12 from Jim Ross (Enervest Contractor) He told me that there is oil in Buckeye Creek and that they set 3 booms. Jim also told me that the oil is coming from upstream of their production field. I called Bill Mitton (Knox Energy) and the OEPA Spill Hotline, then responded to the site.
1347908268 2012-09-10 Plug / Plug Back No Violations Met JD (Berry Well Service) at the access road to the rig at 0915 hrs. Jon Scott had Jury Duty would not make the plugging activity. On my own until later in the morning when Josh Garland arrived to over-see the plugging. Berry Well service was on location and running tubing to bottom to sound the depth and determine if there were no plugs. None were found. Formation Cementing ran the first class A cement plug inside the 4.5-inch csg from 1627 feet to 1293 feet, greater than 300 feet interval covering the Berea Sandstone perfs from 1601 to 1592 feet. The second cement interval was from 787 to 453 feet covering the 1st Cow Run perfs from 705 to 693 feet. Top of cement between the annular space and the 4.5 csg was at 450 feet. Berry used a knife and sounded the collars above 450 feet for telegraph. They found the first telegraphed collar at 329 feet and to tried to rip the csg there. After several hours and no luck at that depth, they moved up hole and tried to rip the pipe apart at the next collar at 298 feet. After spending fifteen minutes they pulled the tubing out and discovered the deployment spring to push the knife out from its nest was weak. Replaced the spring and returned to the collar at 298 feet. They applied 30,000 lbs pulling pressure on the 4.5-inch casing while using the knife to unseat the threads. Still didnt work so they finally backed off the 4.5-inch csg and it unscrewed at the 298 feet collar. The third cement plug was run from 300 to 150 feet and finally the last plug was run from 100 to surface. Formation Cementing placed fresh water gel as spacers in between the cement plugs starting from the top of the 1st (bottom) plug to the base of the fourth plug.
1385488233 2013-11-25 Final Restoration No Violations Met Joe Justice at home site and went to the location of this well and inspect the final restoration. This location had new vegetation cover the well site. Mr. Justice was not happy that vegetation was variable. He was expecting grass only. Seed had been planted over this impacted area from the well, but did not cover the entire area. Lots of weeds and wild flowers were the dominant ground cover. I told him unless he specified to the company when they consummated the lease that he only wanted grass there wasnt much he could do about the consistency of the ground cover. In examining the soil at this site I also explained that there was very little organic rich soil at the surface. His soil may also be responsible for the plant material. The site passed all the requirements for final restoration according to the state.
