The meeting began without the presence of Mr. Paniccia. Mr. Ayers represented Mr. Paniccia and disputed ownership of the wells. The enforcement history and case files were brought to Mr. Ayers attention (Note: Also see memo to file between Tom Tugend & Randy Ayers on 5/18/2012). The well locations and property were discussed and reviewed. Mr. Mitton discussed the potential working agreement and specific locations between both parties to perform cleanup, place wells back into production and/or plug and abandon. At the conclusion of meeting, Mr. Paniccia arrived at the property and when asked about ownership stated that I own the wells. Mr. Ayers quickly responded by stating that you dont own the wells. The two parties agreed to move forward and compose an agreement. Note: No inspections were conducted this day. |

During the inspection, it was noted that the well was idle. The well consisted of only rods, tubing, and 5.5 casing equipped with a wellhead. A pumping unit remained at the well location but had been disconnected. The immediate well location also contained oil saturated ground that extended approx 15 in diameter from the wellbore with no observed offsite impact. The displayed identificaiton incorrectly stated Permit No. 4609. The tank battery consisted of (1) 100 bbl with an identification stating Hoyt-Parrill & Co. and Permit Nos. 4607, 4608, 4609 and 4610 and an approx 150 bbl horizontal saltwater tank at full fluid capacity. A GPS reading was obtained and recorded for the well. Note: The enforcement case file for wells located on this property date back to the mid-1990s. This case will be discussed with Division Management. |

A large rainfall event that ocurred last night appears to have washed oil from the well down the lease road to a water hole. The water hole was approximately 80 x 12 in area. It did not appear oil had entered any ditches or streams although there is a culvert within 5 feet of edge of the water hole. NW Region Supervisor Will Ziegler was contacted immediately. I was instructed to contact Mr. Frank Paniccia, landowner and alleged well owner, regarding the cleanup and remediation. Mr. Paniccia was contacted at 9:17 AM via telephone and stated that he owns some of the wells on the lease but not all of them. Mr. Paniccia asked that I contact Mr. Randy Ayres (sp?), an employee of Mr. Paniccia, and that he would be of more help in the matter as he is more familiar with the property. Mr. Ayres was contacted and he stated that Mr. Paniccia does not own any of the wells and is not responsible for the cleanup. Region Supervisor Will Ziegler and Orphan Program Manager Gene Chini was then consulted with regarding who is responsible for the cleanup. Photos were taken of well location. |

Mr. Mitton brought with him four bags of peat absorbent material and two bags of absorbent diapers. The diapers were used on the water hole to skim the oil to one side where it could then be absorbed with the diapers. Once finished there was no visible oil on the surface of the water. The diapers were disposed of in a plastic trash bag. Peat absorbent was spread around the wellhead area on top of the oily ground surface. It appeared that the source of the oil has been leaking from a 2 threaded hole on the 5.5 casing head. Mr. Mitton installed a 2 fitting to prevent oil from escaping the well. Diapers were then placed near the edge of the oily ground surface to catch any future runoff and preventing oil from getting to the water hole again. Mr. Mitton said that they would come back and remove the diapers and add more peat absorbent if it was necessary. Photos were taken of cleanup. Work was completed at approximately 4:00 PM. |
