0541631592 2009-09-01 Production Wells Violations Noted An inspection was conducted with Mr. Jeff Fry, West Region Oil & Gas and UIC Field Supervisor. During the inspection, a bare area over hillside located below the tank battery for Tedrick (Permit No. 348), Phillips (Permit No. 698), and Dearth (Permit No. ) wells was observed. The impacted area measured approx 75 (length) x 30(width). Inside the earthen dike, contamination and pollution (C&P) was found in several areas to include location above bare area. The earthen dike is not able to prevent escape of C&P. A 100 bbl tank for this well also contains a leak. Clay has been placed around the outside of tank and crude oil observed leaching through material. Called Mr. Doug Kitchen at 11:24 am at his office and spoke with secretary whom, stated that he is unavailable due to a meeting. Left message for him to return call asap. Called and left message on Mr. Doug Kitchens cell phone at 11:26 am with more detail. Called Mr. Ron Mcbride, Chieftain Energy Contractor, on his cell phone at 11:30 am. No return call. Mr. Paul Grims employees were driving by location therefore flagged down. They arrived on-site at 11:56 am and were informed of inspection results. Mr. Grims empoyees state that impacted areas were caused by Doug Kitchen.

The landowner states that he is receiving small amount of house gas from the Phillips #2 and the Dearth well. Both of these wells are tied in together and routed to his residential dwelling. Witnessed the Phillips #2 well pumping. A meeting will be held with Mr. Joe Hoerst and Mr. Kitchen on 1/2/2008 regarding the Chief Orders.

The vegetation is patchy but does show signs of growth. P&C still exists inside the dike, earthen dike needs repaired, and leaking tank has not been repaired. 1 flowline from bottom of 100 bbl tank routed to 210 bbl tank inside Paul Grims shop has not been repaired.

1795932108 2009-09-15 Production Wells No Violations A follow-up inspection with Mr. Robert Stonerock, Oil & Gas South Region Supervisor, revealed non-compliance. Myself along with Mr. Stonerock met with Mr. Paul Grim at his shop at 3:15 pm. Advised Mr. Grim of the existing violations at his shop in Vinton County. Mr. Stonerock stated to Mr. Grim that the DMRM is aware of the possible transfer of wells from Chieftain Energy to Paul Grim. More importantly, we want him to know of the existing violations such as, Permit No. 705, McGlaughlin SWIW #6. I referred to the three (3) options that had been suggested to Chieftain Energy, in order to achieve compliance with concrete dike. Mr. Grim informed that pump no longer leaking and bare areas exist at shop. Mr. Grim replied by stating that at least they would not have to mow. Informed that tanks and earthen dikes are leaking and to add organic material (horse manure, lime, seed and mulch to location(s).

High Range Quantabs placed in fluid showed 8.6 units before stopping test. Outside dike at top of hill outside dike exceeded 10 units. 100 bbl tank with clay placed around the outside still leaking. The contaminated material inside dike needs removed. Additional mulch, manure, lime and seed needed outside dike extending over the hillside.
