0093223548 2014-09-10 Production Wells Violations Noted Performed an inspection on this well in response to a landowner complaint. Upon inspection, it was observed that the well is shut in and is idle. The well consists of a pumping unit over 7 surface casing and 2 tubing on a packer. According to RBDMS production records, this well has shown 0 production for oil and gas since 2007. Judging by the condition of the production equipment, this well has been idle for several years. There is no identification information posted at the well head or the tank battery. The tank battery consists of two 100 bbl production tanks, two mechanical separators, and two production meters. There is no containment dike around the tank battery, and one of the production tanks has a large hole near the bottom weld that has leaked in the past. A containment dike designed to hold 110% of the production tank capacity as per SPCC requirements must be constructed. Photographs were taken to support the findings of this inspection. This well shall be plugged by the operator. Deer Oil & Gas will have 180 days upon receipt of this notice to plug and abandon the well.
0153399900 2010-10-25 Production Wells No Violations Inspection this day due to complaint by landowner, Randy Wagner, that wells were not producing. This well has pump jack, electric line curled up around jack and not connected, looks like done when field was plowed. Valved are shut, well is not prouducing, no IDs at well but Randy does not want me writing NOVs for these 3 wells. Good IDs at tank for wells. Production records show no production from 2007 to current. Randy requests production information from 1997 on and this has been mailed to him.
0372798110 2015-06-29 Production Wells No Violations Met with Aaron Wolfe of OEPA DERR and SW Region Emergency Operations Manager Trisha Cartmell to evaluate cleanup efforts on this location. Upon inspection, it was observed that all oil product has been removed from the location and there is no longer sheen appearing in the stream. All hard and soft booms were removed from the location. The original compliance notice dated 6/7/15 can be closed out.
0412001840 2016-02-08 Administrative Inspection No Violations Spoke over the phone at 1:50 pm with complainant Mr. Randy Wagner. Mr. Wagner called to inquire about the process of obtaining exempt domestic ownership of the well from Deer O&G as a result of the current litigation over the well in lieu of them plugging the well. I explained the definition of an exempt domestic well to Mr. Wagner and stated that if the well is capable of meeting that definition, than the division would likely consider the transfer. I also explained to Mr. Wagner that as the well sits right now, Deer O&G is still required to plug and abandon it.
0518860321 2014-10-16 Production Wells No Violations Met with Mr. Gordy Deer of Deer O&G on this location to discuss violations associated with this well. Mr. Deer stated that he and the landowner, Mr. Randy Wagner, have had disagreements over ingress/egress to and from this well. Both Mr. Deer and Mr. Wagner have gotten attorneys involved with this situation. I explained to Mr. Deer that the compliance issues with the well need to be resolved by the 180 deadline set on 9/10/2014 in order to avoid further legal action. Mr. Deer stated that he would be bringing equipment in as soon as possible to put a dike around the tank battery, clean up oily sludge, and remove the 100 bbl tank that has a hole in it. Mr. Deer also agreed to put legible and correct IDs up at the well head and tank battery. I will continue to monitor the progress of this situation.
0575270152 2015-06-11 Production Wells No Violations Upon inspection, it was observed that the bulk majority of the free product has been removed from the creek/drainage ditch. The hard and soft booms are still in place and are collecting any residual product before it migrates further downstream. I will continue to monitor the progress of this cleanup. I was accompanied on this inspection by ODNR DOGRM Emergency Operations Manager Trisha Cartmell.
0720836091 2016-05-13 Administrative Inspection No Violations Received call from complainant Randy Wagner at 11:31 am. Mr. Wagner stated that the well is still in litigation, but a deal will likely be reached soon to either allow Deer Oil & Gas to put the well back into production, or require him to plug and abandon the well. I spoke with Gordon Deer at 11:53 am and he stated he believes the well will produce, but will plug if required.
0738412387 2015-10-05 Production Wells No Violations Upon inspection, it was observed that this well is still idle and incapable of production. There are no lines connected to the well head. The chart in the meter run is from April 2012 and shows 0 production. No dike has been built around the tank battery, however legible and correct ID information has been posted. I spoke with Gordon Deer at 5:23 pm and requested a meeting on the location to discuss plans for either plugging this well or putting it back in production. A meeting is scheduled for next Tuesday at 9:00 am.

1404870139 2015-12-21 Administrative Inspection No Violations Spoke over the phone with Mr. Gordon Deer at 12:52 pm. Mr. Deer stated that he is being sued by complainant Mr. Randy Wagner over nonproduction of this well. Mr. Deer stated that he will likely plug this well if he cannot reach a deal with Mr. Wagner or find a buyer for the well. I spoke with Mr. Wagner at 1:12 pm and he stated that he may wish to have ownership of the well for domestic purposes.
1433717451 2015-06-07 Production Wells Violations Noted Received complaint from landowner Mr. Randy Wagner stating that an oil spill occurred on this well location over a month ago and that oil is still present in the creek running through his farm ground. Upon inspection, it was observed that free product in the form of crude oil escaped from a leaking pipe nipple on a buried flow line between the well head and tank battery. The free product flowed down a drainage ditch and into a culvert leading into a small creek/drainage which flows to the Ohio River. The free product migrated approximately 200 yards from the spill origin and did not make it to the Ohio River. Mr. Gordon Deer of Deer Oil & Gas has been notified of the spill and cleanup activities have already commenced. Mr. Aaron Wolfe of Ohio EPA met me on location to assist in making recommendations for proper cleanup of the creek. Required corrective action will consist of the following: 1.) Remove all free oil product from the creek with the use of absorbent pads, hard booms, soft booms, etc. as needed. 2.) Excavate all contaminated soil present in the ditch line leading from the spill origin and lime, seed, and mulch. 3.) Dispose of all associated cleanup waste at an EPA approved landfill. 4.) Maintain and monitor hard and soft booms until oily sheen is no longer present in the creek. Deer Oil & Gas will have 14 days upon receipt of this notice to reach compliance.
1445003020 2015-10-13 Production Wells No Violations Met on location with Mr. Gordy Deer of Deer O&G to discuss compliance issues with this well. Mr. Deer stated that he is in the process of removing the old 100 bbl production tanks, separators, drips, and meters from the tank battery and replacing with a smaller 30 bbl production tank, new separator, drip, and meter run for P#24387 only. Mr. Deer will lay a new line from the well to the tank battery as well as a new sales line from the separator to Stevens O&Gs line which is .5 mile up SR-7.

1676906235 2016-01-15 Production Wells No Violations Upon inspection, it was observed that this well is still idle and incapable of production. There are no production lines attached to the well at any connection. This well is currently in a legal case between complainant Randy Wagner and well owner Gordon Deer. I spoke with Mr. Deer on location today and he stated he is awaiting a decision from said legal case which will determine if he plugs the well or surrenders it to Mr. Wagner along with the lease. New photos were taken of the well.

The wellhead consists of a 4 1/2 inch diameter production casing and 2 inch diameter production tubing. The well is idle at this time and there has been no resolution to the issue of this well being idle.
1946953111 2015-06-15 Production Wells No Violations Returned to this location to gather GPS coordinates for the tank battery and entry point. Upon inspection of the spill area, the affected creek/drainage ditch is showing very little sheen. The hard and soft booms are still in place and are preventing any residual oil from migrating downstream.
