Pit covered with 20 mil plastic with discharge line from rig to pit secured with cement blocks. Cuttings flow to a rubber pad that is located in the pit along with a diffuser fitting at the end of line. No freeboard issues.

Mark Shoemaker will be company man for PNG. Union was moving in equipment. Double filter fence (sock and filter fence) was installed. Access road was in the process of completed. PNG will go with 24¿ conductor pipe to about 50 ft . Change to 13 3/8¿ to 120 ft. Each pipe will be cemented. Spud called for 9/30/10. PNG supplied DEP with a drilling plan for the proposed storage well.

Well re-permited due to deviation in drilling. Site properly signed (new permit no) with E&S plan onsite. Access road entrance muddy, recommend operator add additional rock to entrance. Bmp¿s were installed down gradient, noted that filter fence was improperly placed before brush/grub; therefore, operator chose to place compost filter sox below brush/grub line. Well pad very muddy, again recommend operator rock in order to prevent a possible pollution event and/or accident. Pit lined, liner properly secured (edges backfilled) but noted that liner was not smooth, and slopes may be over 2:1. Recommend that operator/drilling closely monitor pit freeboard levels on ALL SIDES OF PIT. Accompanied by WQS Dana Burk.

No accelerated erosion or sedimentation issues noted with access road or well site, appears all bmp¿s functioning properly. Noted that pad had been adequately rocked to reduce mud. Spoke with driller Mark Shoemaker (Union Drilling) about possible concerns with pit. Diffuser placed on drill pipe and an additional piece of rubber matting placed directly below pipe in pit. Driller has plans to hose down any cuttings that accumulate on cutslope side of pit into pit in order to ensure freeboard is maintained. No freeboard issues noted during this inspection. Recommend that operator continue to closely monitor pit freeboard levels and all bmps. No IW issues were noted. Accompanied by WQS Greg Higgins and Marc Maestra.

Union drilled 17 ½¿ hole and set 13 3/8¿ pipe to 123 ft with 105 sks of Class A and 5 bbl return. Union drilled to 1666 ft. and set 9 5/8¿ pipe and used 480 sks Class A with 22 bbl return. Plug down at 03:30 hrs on 10/8/10 and started up at 11:30 hrs. Union was cutting pipe to set BOP and converting to mud drilling. Pit covered with 20 mil plastic with discharge line from rig to pit secured with cement blocks. No freeboard issues. Met with PNG representative Paul Sekinger and inspected site. PNG is going to re-establish access road to pit in order to start removing water from pit located on southern portion of pad. DEP request to add access road to E&S pad

1920412	Primary Facility	2010-10-12	Routine/Complete Inspection	No Violations Noted	During this inspection, well was actively being drilled. Site sign with ES plan present. Spoke with driller about monitoring pit freeboard levels, as it appears they currently exhibit 3-4ft of lined freeboard. He sated that today was last day for air drilling; therefore, amount of materials going into pit should decrease, but he will continue to monitor and pump if necessary. No accelerated erosion or sedimentation issues were noted in relation to site or access road. Bmp¿s are installed and functioning down gradient of pad and along access road. Pad and access road entrance adequately rocked. No IW issues were noted. Plans are to conduct a site inspection on Oct 19, 2010 with engineer Paul Sekinger of PNG.

No accelerated erosion or sedimentation issues were noted. All installed bmps properly funcitioning and continuely monitored by operator. Two foot of lined freeboard observed. Pit appears structurally sound. Paul stated that a 30mil liner used in pits.Operator has plans to dispose of all pit contents offsite to an approved location. Noted that a vegetative thru way around pits would be used to vacuum pits out, this is area is included in original area of disturbance and does not appear to require adtl bmps. Access road stable. Paul also indicated that constructed on pipeline that runs parallel to access road is anticipated to begin next week. Discussed restoration plans. It appears that operator will restore as much as possible to preexisting contours with access road and small pad left; goal is to have pits properly removed and backfilled prior to winter. It is reccomended that operator continue to monitor all bmps until final restoration activites complet

Access road and pad exhibit minor erosion concerns due to heavy recent rains and truck traffic; therefore, operator should continue to monitor/maintain all temporary BMP¿s until final site restoration has been completed, which includes ditches, sediment traps, and filter fence. Two lined below grade pits located on well site with adequate freeboard. Pits currently being pumped out by Dively¿s Trucking, operator has plans to dispose of all pit contents off site. Spoke with Paul Sekinger, of PNG on 4-21-11 onsite meeting scheduled for April 27. Department unable to locate official Well Record Completion Report; therefore, recommend that operator resubmit, as final site restoration is required by regs within 9months of completion of drilling, unless otherwise approved by the Dept.

WRACR indicates drilling completed on 10/29/10; therefore, 9 month restoration deadline is 7/29/11. Disturbed areas have been seeded and mulched, but NO Growth observed (appears restoration efforts were completed very recently). Accelerated erosion and sedimentation issues noted on well pad, also observed that sedimentation has occurred outside BMP¿S (see pictures). Violations are being issued for failure to restore within nine months of completion as well as failure to maintain BMPs to minimize the potential for accelerated ES.

At the time of inspection, previously eroded areas on well site appear to have been improved, bmps maintained. Area has been re-graded, seeded/mulched with observed growth, approximately 70%. Department recommends that operator re-fertilize area to ensure 70% coverage is sustained uniformly on all areas of the well site to permanently resist the potential for erosion &sedimentation. Operator has plans to leave temporary bmp¿s in place until early spring- to ensure adequate vegetative growth is sustained, upon which all temporary bmp¿s will be removed. Until then operator agrees to monitor and maintain bmp¿s to ensure proper functioning ability. Site has been seeded/mulched with approximately 70% vegetative growth. No new violations were noted during this inspection and outstanding violations appear to be rectified. Department still awaiting 30day requested operator response to notice of violation sent on 9/14/11.

Present from the DEP: myself, WQS Supervisor Ed Ritzer, and WQS Marc Maestra; PNG Reps: Paul Sekinger(Consulting Engineer), Kurt Hundertmark(Manager Ops), Ernie Moses(Sr. Engineer), Joyce Dailey(Legal Counsel), and Missy Galovich(Well Tender). During this meeting, attention brought to ES controls below drill pit, as well as lack of seed and mulch along sides of fill slope of pit. Although recent heavy rains occurred, the department notified PNG 9-2-11 of ES control failures, Dept reminded operator that it is their responsibility to inspect BMPs until final restoration of site is achieved, especially after every rainfall event to ensure proper functioning ability of BMPs.Es conerns addressed, areas prev eroded replaced with seed mulch, site not yet restored to 70% growth. Bmp's will be left till spring 2012 and maintained until final restoration attained.
