I conducted a routine inspection of Snyder Brother's Tucci #8 well (API 047-23705) in Jones Twp., Elk Co. There are no violations noted for the well pad. However a rather large brine release was observed originating from the tank battery adjacent to the well pad. Water and soil conductivity readings confirmed the release. The release is over a barrel of fluid and was not reported to the Department. This constitutes violations of 78.57(a), CSL 402(b) and SWMA 301. Violations of 91.33(a) and 78.66(a) have been closed as "unresolvable".
You are hereby requested to follow Department Policy 800-5000-001, Addressing Spills and Releases at Oil & Gas Well Sites or Access Roads. This Policy sets forth the procedures that should be followed to resolve the violations associated with the spill/discharge/release noted in this Notice of Violation by using either the Act 2 or the Alternative Remediation Process. A copy of this Policy is attached for review. |

Of concern was the cleanup effort and violations associated with the brine release from the tank battery adjacent to the well. Upon inspection, filter sock had been installed around the impacted area; however, there was no evidence of excavation or sampling at the release site. Failure to remove a pollutional substance from the ground or waters of the Commonwealth within 15 days of the release constitutes a violation of 91.33(b). In addition, the outstanding violations associated with the release from inspection ID 2602161 are being cited again for this follow up inspection. Violations associated with the failure to report the release have been closed (on 7/27/17) as "unresolvable". All associated violations with his release will be resolved upon compliance with the Department's Spill Policy 800-5000-001. |
