Department spoke with Operator Rep Richie Vrobel by phone. Mr. Vrobel stated well tender was servicing well when he noticed 14.5 bbl of brine was unaccounted for. Well tender was last at site on 5-26-16 and did not notice any sign of a release. Mr. Vrobel inspected brine tank valve and nipple and did not notice any issues. Mr. Vrobel also stated brine tank was located in an earthen dike and well did not produce petroleum products. Mr. Vrobel does not believe any waterways were affected, however a stream is located approximately 100 yards down-gradient of site. Mr. Vrobel stated truck was coming to empty tank at 11:30 and Spartan was coming tomorrow to collect soil/brine tank samples and take measurements with a soil probe. At time of inspection brine tank has been removed from site. Plywood removed from site. Department e-mailed Operator Rep Richie Vrobel and requested photos of tank. Mr. Vrobel sent pictures of tank and site taken on 6-27 and 6-28-2016. From photos it appears the tank is compromised. Department contacted Mr. Vrobel by phone and requested information on samples that were taken. Mr. Vrobel stated that Spartan collected one water sample from the brine tank (0.06 micro semens) and 2 soil samples taken from soil located under brine tank (one sample was 0.02 micro semens and the other was 0.04 micro semens). He stated that no excavation is planned a this time because he feels the release was rainwater. However, since Operator reported a 14.5 bbl release of brine, Operator is required to follow spill policy to remediate impacted area unless Operator provides documentation showing fluid in brine tank was fresh |

Department received Operator 15 day response to violation. Operator states that well tender erroneously reported the 14.5 bbl release. Operator also states that the release was not brine but freshwater; fluids from the brine tank were tested and results indicated water was freshwater. According to Operator, soil samples were taken after brine tank was removed and preliminary results indicate soil is brine free. In addition, soil sample results sent to the lab will be forwarded to the Department when they are received. Operator states that the well has not produced brine or been blown down to the tank since at least 5-28-15. Department recommends Operator submit to Department a map showing soil sample locations. |

Department reviewed sample results provided by Operator Rep Jessie Valentine by e-mail on 7-19-16. Based on the analysis provided by Microbac labs of the water sample collected from the brine tank, it appears that the fluid in the brine tank was not indicative of brine. In addition, the analysis of the two soil samples does not show elevated levels of Constituents of Concern indicative of a brine release (as listed in the Program Clarification -Common Constituents for Oil and Gas Related Spills and Releases). Based on these findings, it appears the 14.5 bbl release of brine reported by the Operator was not brine. At this time it appears the Operator is In Compliance with Policy. Previously issued violation has been closed. UPDATE 9-7-16: Inspection result changed from ICP to NOVIO. |
