Waiver of distance requirements from stream approved 12/15/08. Inspection revealed the following deficiencies: 1) Failure to implement E&S plan, and maintain E&S controls. Silt fence was installed along portions of the down-slope side of the site, with hay bales installed along the remainder. E&S plan called for 30" silt fence along the entire down slope side of site. Silt fence and hay bales were not maintained. 2) E&S plan not adequate. E&S plan approved with the waiver was not the same E&S plan on site. Top hole disposal and disposal of cuttings was not properly addressed in the on-site plan. 3) Failure to comply with terms and conditions of permit. Terms and conditions of E&S plan that was approved in waiver as part of the permit were not complied with.
