Containment was also being used for pumps and generators that were not within the drilling mat area. No evidence of leaks or spills was observed. At the time of inspection, the pad surface was very muddy. However, all of the mud was contained on the pad. No voilations were cited during this inspection. |

Because the brine spilled on the pad surface, this release had the potential to pollute waters of the Commonwealth, which is in violation of 35 P.S. § 691.402(b). Title 35 P.S. § 691.402(b) prohibits conducting activities regulated by permits issued pursuant to Section 402 of The Clean Streams Law to prevent the potential of pollution contrary to the issued permits or without a permit.
