The Department notes that the Operator had to alter their access point to the lease property in order to fulfill the requirements of the violations. The Department would like to commend the Operator on their effort to resolve these issues. The Department suggests the Operator continue to monitor the site to ensure accelerated erosion and sedimentation is controlled and further issues at this site are avoided.
2254101 Primary Facility 2014-03-11 Complaint Inspection No Violations Noted Inspection in response to complaint #302937. Meeting on site with Biologist 3 Dan Counahan to review the Operators plan and permits to install a stream crossing. At the time of inspection the Operator had an Army Corp stream crossing permit and an Erosion and Sedimentation plan. Upon further inspection the Department found what appeared to be a wetland, and the area that the proposed road crossing will impact this probable wetland appears to be less than 1/10 of an acre in size. The Department suggests the Operator submit plans and obtain a GP 7, which is a Chapter 105 permit for a permanent road crossing of streams and wetlands from the Oil and Gas Office. If the proposed limit of disturbance is more than 5,000 square feet, but less than 5 acres, the E&S Plan should also be included with the 105 Permit for Department review and approval. If the LOD is over 5 acres, the applicant should submit an ESCGP-2 to the Department for a separate review and approval. At the time of inspection the Site ID sign was installed.

The wetland delineation submitted on October 30, 2015 by the operator’s contractor was deficient. WQS Steingrabe requested a meeting with the Operator and wetland delineation contractor .

The Department and Operator met onsite to review the current site conditions and discuss the previous delineation performed by the operator’s consultant.

The Operator agreed to forward the results of the previous wetland delineation in a formal report within two weeks of the date of this inspection, but no later than June 1, 2016.

During the inspection, no accelerated erosion or sedmintation related to the well site or access road was observed.

The Department notes that the site appeared temporarily stabilized. Temporary BMP’s were in installed and appeared to be functioning properly. However The Department observed several areas within the limit of disturbance that do not currently exhibit 70% uniform ve

The Operator submitted the wetland delineation on 6/6/2016. The wetland delineation is being reviewed by the Oil and Gas Technical Services Unit.

During the inspection, no accelerated erosion or sedimentation related to the well site or access road was observed.

The Department notes that the site appeared stabilized. Temporary BMP’s were removed with the exception of the silt fence near the stream crossing. On 5/17/2016, the department suggested the Operator leave the silt fence until the area exhibits 70% uniform vegetative coverage that is required for permanent stabilization and, final restoration. See attached photos.

The Department suggested the Operator scarify, reseed and mulch areas that do not exhibit 70% uniform vegetative cover.

The Department notes that the site appeared to be stabilized with 70% uniform vegetative coverage sufficient to prevent accelerated erosion and sedimentation. The Department suggests the Operator remove the silt fence BMP’s from the stream crossing area and reseed and mulch those areas in order to maintain vegetative coverage. All other BMP’s have been removed. The site is restored.

The wetland delineation is currently under review the Oil and Gas Technical Services Unit.
